SPRITE CHILL BILLBOARD CONTEST OFFICIAL RULES

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID OUTSIDE THE ELIGIBILITY AREA AND WHERE PROHIBITED  

1. Eligibility: The Sprite Chill Billboard Contest (The “Contest”) is open only to legal residents of 50 U.S. and DC (“Eligibility Area”) who are 13 years of age or older at time of entry (“Entrant”). If participant is a minor, they must obtain the permission of a parent or legal guardian to participate. Void outside the Eligibility Area and where prohibited or restricted by law. Employees and non-employee workers of The Coca‑Cola Company (the “Sponsor”), Coca‑Cola Ltd., Coca‑Cola bottlers, Don Jagoda Associates, Inc. (“Administrator”), and any of their respective parent companies, affiliates, subsidiaries, advertising agencies, and any other company or individual involved with the design, production execution or distribution of the Sweepstakes (collectively, the “Released Sweepstakes Parties”) and their immediate family (defined for the purposes of these Official Rules as: spouse, parents and step-parents, siblings and step-siblings, and children and step-children) and household members (people who share the same residence at least three [3] months out of the year) of each such individuals are not eligible. This Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Participation constitutes Entrant’s full and unconditional agreement to these Official Rules and Sponsor’s and Administrator’s decisions, which are final and binding (without right of appeal) in all matters related to the Sweepstakes. Winning a Prize is contingent upon fulfilling all requirements set forth herein. If you are a minor, you must have your parent or legal guardian agree to be bound by these Official Rules and all provisions included in the Official Rules.

2. Contest Period: The Contest begins at 10:00 am Eastern Time (“ET”) on May 6, 2024 and ends at 11:59 pm ET on June 2, 2024 (“Contest Period”).

3. How to Enter: There is NO PURCHASE NECESSARY to participate in the Contest. A purchase does not increase your chances of winning.

During the Contest Period, look for special advertising with a Quick Response (“QR”) code. Scan the QR code with your web-enabled mobile device (“Device”) to be directed to the Contest Snapchat Lens. Follow the instructions in the Lens to access the Contest site (“Website”). Follow the instructions on the Website to upload your selfie (the “Submission”) and complete the registration form to receive one (1) entry (the “Entry”) into the Contest.

Please make sure to note the following regarding your Entry:

  • You must be the only person in your Entry. 
  • The Entry must not contain content that is known by you to be false, inaccurate or misleading.
  • Any Entry deemed inappropriate or unsuitable, in Sponsor’s sole discretion, will be disqualified. Entry must not contain material that is inappropriate, indecent (including but not limited to nudity, or pornography), profane, obscene, hateful, tortuous, defamatory, slanderous or libelous (including words or symbols that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation, or socioeconomic group). 
  • Entry must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.
  • The Entry must not contain criminal or tortuous activity, including but not limited to child pornography, fraud, trafficking of obscene material, drug dealing, drug use, or gambling. Entry must not contain material that is unlawful, in violation of or contrary to all applicable local, state, federal, or international laws and regulations.
  • Entries must not feature beer, distilled spirits (i.e., hard liquor, malt beverages), tobacco products (including cigarettes, cigars, pipe tobacco, chewing tobacco and snuff), fireworks, firearms and ammunitions, prescription drugs, illegal drugs and related drug paraphernalia, nutritional supplements, lotteries and gambling.
  • Any Entry or portion thereof that is, in Sponsor’s sole discretion, obscene, profane, lewd, defamatory, contains any third-party materials, or otherwise violates or infringes (or may infringe) any copyright (including music recordings), trademark, logo, mark that identifies a brand or other proprietary right of any person living or deceased (including but not limited to rights of privacy or publicity or portrayal in a false light) or entity or make reference to any commercial/corporate advertising (including but not limited to corporate logos, brand names, slogans, political, or religious statements), or is otherwise objectionable, will not be considered and will disqualify the Entrant. 
  • Clothing worn in the Entry should not contain any visible logos, drawings, cartoons, phrases, trademarks or other third-party materials.
  • Entry must not include any representation of celebrities, athletes, musicians, or any other public or private figure, include any anti-social, political or religious groups, any commercial solicitation or promotional materials or name, address, phone number, or URL address.
  • Entry must not contain advertisements, personal solicitations or commercial solicitations. 
  • Entry may not be owned, taken or edited by a professional photographer/videographer.
  • Entry must not contain viruses, Trojan horses, worms, bots, spyware or any other computer code that is intended to damage, interfere with, or surreptitiously intercept or expropriate any system, data or information.
  • Entrants and all submitted Entries must be in keeping with Sponsor's image/The Coca‑Cola Company or brand image as determined by Sponsor, in its sole discretion, or Entry will be disqualified from the Contest. The Entry must not disparage persons or organizations associated with Sponsor.
  • Entrants and all submitted Entries may not negatively reference any of The Coca‑Cola Company’s competitors, in Sponsor’s sole discretion.

All Entries submitted become the property of Sponsor upon submission and will not be returned. Each Entrant grants to Sponsor a worldwide, royalty-free, perpetual, non-exclusive right and license to copy, distribute, and display each submitted Entry, in any media, and with right to use, copy, modify, edit, and create derivative works there from, and agrees to execute documents confirming such right and license (as further defined in Section 7 below) at Sponsor’s reasonable request. Any Entry deemed inappropriate or unsuitable, in Sponsor’s sole discretion, will be disqualified. By entering, you understand that your Entry (or portion thereof) may be posted online, in Sponsor’s sole discretion, to be viewed by members of the general public. Entrants may not copy or otherwise plagiarize any portion of the Entry from any source. No information regarding Entries or judging, other than as otherwise set forth in these Official Rules or on the website listed above, will be disclosed. All eligible Entries must be received during the Contest period to be eligible. Limit one (1) entry per person/email address. Any attempt by any entrant to obtain more than the stated number of Entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void such entries and that entrant may be disqualified. Use of any automated or computer system to participate is prohibited and will result in disqualification. Normal Internet access and usage charges imposed by your online service may apply.

4. Winner Determination, Judging and Winner Notification: All Entries will be judged by Sponsor-selected judges (“Judges”) on or about June 3, 2024 based on the following criteria: Visual Appeal/Appropriateness to the public image of the Sponsor (50%) Originality/Creativity (25%); and Quality/Composition of image (25%) (the “Judging Criteria”), to determine at least one (1) Prize winner. Any tied Entries will be re-judged by the judges based 100% on Appeal/Appropriateness to determine the winner. By participating, Entrants agree to the decisions of the Judges/Administrator, which shall be final and binding in all respects. No information regarding Entries, random drawing or judging will be disclosed to any third party not involved in the conduct of the Contest. The potential Prize winner (or their parent/legal guardian if the winner is a minor) will be notified by email and will be required to sign and return, a Declaration of Eligibility and liability and publicity release and assignment of rights (“Declaration”), except where prohibited, within three (3) days of notification attempt or prize may be forfeited and an alternate winner may be determined. If the potential Prize winner fails to return the completed Declaration within three (3) days, or if Declaration is returned as undeliverable or if the potential winner is deemed ineligible, an alternate potential winner may be determined. If the winner is a minor, one of the winner’s guests must be their parent/legal guardian. All guests must execute and return a release of liability prior to use of prize. Judges’ decisions are final with respect to all matters relating to the Contest. By participating, Entrants agree to the Official Rules and the decisions of the Judges, which shall be final and binding in all respects.

5. Prize (a minimum of one): Your photo featured on a Digital Sprite billboard. There is no retail or other monetary value to the Prize.

No transfer, assignment, or substitution for any prize will be permitted, except at the sole discretion of the Sponsor. Any and all applicable federal, state, and local taxes and all fees and expenses related to acceptance and use of Prize not specifically stated herein are the sole responsibility of the prize winner. Neither Sponsor shall have any responsibility or liability whatsoever for any property loss, damage, personal injury, or death, in connection with the prize provided pursuant to the Contest and/or any Entrant’s participation in the Contest.

6. General Rules: By participating in the Contest, Entrant (or their parent/legal guardian if the Entrant is a minor) agree to be bound by the Official Rules and the decisions of the Sponsor. Judges’ decisions are final on all matters relating to the Contest. All Entries will be declared made by the authorized account holder of the e-mail address submitted at the time of Entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. The Sponsor and its agencies are not responsible for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized in the Contest or by any human error which may occur in the Contest. Sponsor reserves the right to cancel the Contest or online voting elements if any aspect of the Contest becomes technically corrupted, and determine the winners from Entries received prior to cancellation. The Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the Entry process or the operation of the Contest or Contest Application; violates the Official Rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. The Sponsor and its agencies and each party’s respective affiliates, officers, directors, agents, and employees will have no liability or responsibility for any claim arising in connection with participation in the Contest or the awarding of prizes. Winners assume all liability for any injury or damage caused, or claimed to be caused, by participation in the Contest or use or redemption of prize.

7. Release: By submitting an Entry, you (or your parent/legal guardian if you are a minor) hereby grant the Sponsor, its affiliates, subsidiaries, assigns, licensees, and legal representatives the irrevocable, perpetual, worldwide right to use, reproduce, edit, market, store, distribute, have distributed, publicly and privately display, communicate, publicly and privately perform, transmit, have transmitted, create derivative works based upon, and promote the Entry (as such may be edited and modified by the Sponsor in its discretion) for editorial, commercial, promotional and all other purposes (including posting on any websites). In addition, you (or your parent/legal guardian if you are a minor) hereby assign to the Sponsor all rights, titles, and interests that you may be deemed to have in any reproduction, product, or derivative work using or incorporating the Entry. You (or your parent/legal guardian if you are a minor) represent and warrant that: (i) the Entry does not and shall not infringe on any copyright or trademark or any other third-party right nor violate any applicable law or regulation, (ii) you have the right to grant any and all necessary rights and licenses provided herein, including without limitation, all necessary copyright, trademark and other related rights to the entry, free and clear of all claims and encumbrances without violating the rights of any person or entity, including any right to privacy or publicity. You (or your parent/legal guardian if you are a minor) waive any right to inspect or approve uses of the Entry or to be compensated for any such uses. You (or your parent/legal guardian if you are a minor) hereby release Sponsor, its affiliates, officers, directors, agents, co-branders or other partners, and any of its employees (collectively, the "Contest Parties"), harmless from any and all claims, damages, expenses, costs (including reasonable attorneys' fees) and liabilities (including settlements), brought or asserted by any third party against any of the Contest Parties due to or arising out of your participation in the Contest, or use of your name, likeness, Entry and/or voice, or any other rights granted to Sponsor, including any claims for including but not limited to trademark, copyright, or other intellectual property rights, right of publicity, right of privacy or defamation. You (or your parent/legal guardian if you are a minor) further agree to release and indemnify and hold harmless Contest Parties from any and all claims that any commercial, advertising, presentation, web content or any other material subsequently produced, presented, and/or prepared by or on behalf of Contest Parties infringes on your rights as contained in the Entry Submission. Sponsor and their respective affiliates, officers, directors, agents, and employees will have no liability or responsibility for any claim arising in connection with participation in this Contest or any prize awarded. You (or your parent/legal guardian if you are a minor) agree that you shall have no right of approval, no claim to compensation or benefit, and no claim (including, without limitation, claims based upon invasion of privacy, copyright infringement, defamation, or right or publicity) arising out of any use or any editing, distortion, alteration, optical illusion, or use in partial or composite form, whether or not intentional. Your participation is completely voluntary. There is no agreement between you and Sponsor of any kind express or implied, other than as set forth in these Official Rules. You are disclosing your Entry with the full understanding that no confidential or other relationship, fiduciary or otherwise, exists between you and Sponsor. You (or your parent/legal guardian if you are a minor) acknowledge that your participation may present certain risks, and you hereby assume any and all risks, known or unknown, associated with your participation in the Contest. You hereby represent and warrant that you have read these Official Rules, are fully familiar with its contents and agree to be bound by them. The Contest and the Official Rules shall be exclusively governed by and construed in accordance with the laws of the state of Georgia, without regard to conflicts of law provisions. Entrants (or their parent/legal guardian if Entrant is a minor) submit to exclusive personal jurisdiction in Georgia and agree that any dispute shall be brought in the state and federal courts in Georgia.

8. Privacy: Information collected by Sponsor in connection with this Contest may be used by Sponsor and shared with third parties involved in administration of the Contest in accordance with the Sponsor’s online Privacy Policy posted at https://us.coca-cola.com/privacy-policy. The Entrant agrees to the collection, processing and storage of his/her personal data by Sponsor for the purposes of the Contest.
