TERMS AND CONDITIONS OF ENTRY

PROMOTION

1. The Promoter of this Promotion is Coca‑Cola Europacific Partners New Zealand Limited, The Oasis, 19 Carbine Road, Mt Wellington, Auckland (“Promoter”).

2. Information regarding prizes and how to enter the Promotion forms part of these terms and conditions (Terms and Conditions). Entry into the Promotion is deemed as acceptance of the Terms and Conditions.

3. You must be living in New Zealand and aged 18 years or older to enter.

4. Employees of the Promoter, any agency and participating store associated with the Promotion, and the immediate families of such employees, are ineligible to enter. The Promoter’s decision as to eligibility will be final.

HOW TO ENTER

5. The Promotion begins at 12.00am on 21 July 2025 and ends at 11.59pm on 1 September 2025 (Promotion Period). No entries will be accepted outside the Promotion Period.

6. Buy any RUM Co. of Fiji® FIJI DRY® 10 pack in one transaction from a participating store (Qualifying Purchase). During the Promotion Period, scan the QR code on the Qualifying Purchase pack or from point of sale displayed instore and fill out the online form in full to enter the draw. Entrant must enter the last 4 digits of the barcode from one of the Qualifying Purchases as part of the online form. Failure to complete all sections of the entry form may result in the entry being declared invalid.

7. One (1) Qualifying Purchase equals one (1) entry. Fill in a separate online entry form for each Qualifying Purchase. Although multiple entries per person are permitted, entrants cannot submit more than one entry for each Qualifying Purchase.

8. You must keep the original itemized purchase receipt(s) for all entries as proof of purchase. The Promoter reserves the right to disqualify any entries suspected of being fraudulent or in violation of these terms and conditions.

9. The Promoter is not responsible for any technical malfunctions, failures, or delays that may prevent an entrant from successfully submitting an entry.

10. Each participant is limited to a one (1) entry per day.

PRIZE DETAILS

MAJOR PRIZE

11. There is one (1) trip to Fiji for two people (both aged 18+) to be won during the Promotion Period (Major Prize). Winners must redeem the trip by 31 December 2026. Flights are from winner’s closest NZ International airport only.

12. The Prize includes:

a. Two return economy class airfares flying from winner’s closest International Airport to Nadi, Fiji for 2 people (18+) including checked baggage.

b. 4 nights at a 4-star accommodation including breakfast in a double or twin share room

c. Return private airport transfers in Fiji

d. NZ$1,000 spending money for the winner only.

e. The Promoter will pay all airline taxes, fuel surcharges, levies and ticketing taxes payable at time of booking.

13. The Major Prize has an approximate value of up to NZ$10,000. The approximate value of the prize is based on current market rates and may vary depending on the time of booking and travel dates. The Prize is not transferable, redeemable, and may not be exchanged for cash unless the winner elects to receive a cash alternative. The winner may elect to receive a cash alternative of NZ$10,000 in lieu of the Major Prize. This election must be made in writing to the Promoter within 7 days of being notified as the winner. If the winner elects to receive the cash alternative, they forfeit all rights to the Major Prize.

14. All travel is subject to availability at all times and may be dependent on out periods which include all New Zealand and Australian School & Public Holidays along with all other special event periods (such as major sport or entertainment events). All bookings must be made a minimum of 60 days in advance of requested departure dates. Redeeming the prize is conditional on acceptance of the terms and conditions of travel as detailed the airline carriers in accordance with normal travel practices.

15. Both the winner and the companion must be 18+.

16. Winner and companion must be in possession of a valid passport with a minimum of 6 months validity on it prior to departure. Winner is responsible for any amendment fees issued by airlines or suppliers once booking is confirmed and ticketed.

17. Winner is responsible for any additional taxes and/or resort fees associated with the chosen accommodation, unless otherwise stated in the prize description. Visas, valid passports, additional spending money, meals (other than those included as explicitly stated in the prize description) and any other ancillary costs, including but not limited to comprehensive travel insurance and any applicable insurance excesses, not listed in the travel prize package descriptions above are the responsibility of the travel prize winner and their nominated traveling companion as incurred.

18. It is the winner's responsibility to organise transport to/from the New Zealand airport departure/return point. Prize winner and travel companions must have valid travel insurance for their period of travel.

19. The Winner and their companion are responsible for all other expenses/unspecified costs related to the Prize, including but not limited to meals, drinks, laundry charges, activities (unless specified), car hireage, hotel incidentals and in room charges, service charges, insurance (including excesses) gratuities and additional taxes. Unless expressly stated in these Terms and Conditions all other travel and prize related expenses become the responsibility of the Winner and his/her companion.

20. The Promoter is not responsible for any dispute between you and any person with whom you choose to, or choose not to, share a Prize.

21. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the Winner and his/her companion. 

22. It is the responsibility of the Winner and their companion to meet any health and safety requirements applicable to the Prize (for example, in relation to COVID-19), including (but not limited to) obtaining any pre-departure tests or checks, or any other requirements, such as performing and returning negative COVID-19 tests, as may be required by third parties from time to time.

23. Any failure by you or your companion (if applicable) to comply with the conditions imposed by the Prize supplier/s may result in a Prize being cancelled or withdrawn without liability for the Promoter or the Prize supplier/s.

24. The winner and their companion must, if required by the Promoter, sign disclaimer and release forms provided by the Promoter in favour of the Promoter and other parties before taking the Prize.  If you or your companion do not sign, your entry will be deemed invalid and you will lose any entitlement to the Prize. If you or your entry are deemed by the Promoter to breach these Terms and Conditions, including if you are unable to take the Prize on the relevant dates, your entry (or at the Promoter's discretion, all of your entries) may be discarded.  The Promoter may, at any time, require you to produce documentation to establish to the Promoter's satisfaction the validity of your entries (including documentation establishing your identity, age, place of residence and place of employment).  Failure by the Promoter to enforce any of its rights at any stage does not waive those rights.

25. Prizes must not be sold or used, donated, or given away as part of another Promotion.

26. The winners have rights under the New Zealand Consumer Guarantees Act 1993 which cannot be excluded or limited by the Promoter. These rights include statutory guarantees that any goods provided by the Promoter will be of acceptable quality and fit for purpose, and that any services provided by the Promoter will be rendered with due care and skill. These Terms and Conditions do not, and do not intend to, exclude or limit those statutory rights in any way. However, to the extent it is permitted by law to do so, the Promoter makes no representations or warranties, express or implied, under laws other than the New Zealand Consumer Guarantees Act 1993 regarding the quality or suitability of the Prize awarded as part of this Promotion and will not be responsible for breach of such representations or warranties.

27. The Promoters and the agencies and companies associated with the promotion are not liable (including in negligence) for any loss (including indirect, special, or consequential loss or loss of profits), expense, damage, personal injury, illness or death suffered in connection with this promotion or any prize, except for any liability under which statute cannot be excluded (in which case that liability is limited to the greatest extent allowed by law)

28. If any Prize item is unavailable, despite the Promoter’s reasonable endeavours to procure it, the Promoter reserves the right to substitute a different prize of equal or greater value. 

MINOR PRIZE

29. There are two hundred and forty (40) Digital Prezzy Cards to be won (Minor Prize) during the Promotion Period. The breakdown of denominations is as follows:

a. 100 x $100

b. 140 x $50

30. The total Minor Prize pool is valued up to NZ$17,000.

31. The Prezzy Digital Cards have an expiry of 24 months from date of issue. See https://www.prezzycard.co.nz/terms-and-conditions for further information. It is the winner's responsibility to understand and comply with the Prezzy Card terms and conditions. The Promoter is not responsible for any changes to the Prezzy Card terms and conditions."

32. The Digital Prezzy Cards are valid for use in New Zealand only.

PRIZE CONDITIONS

33. The Major Prize winner will be drawn from all eligible entries by 4 September 2025. The winner will be notified via the e-mail address or phone number supplied on the drawn entry form within ten (10) working days of the winning entry being drawn. The Promoter is not responsible for any incorrect or inaccurate information submitted on the entry form.

34. If the Major Prize winner cannot be contacted within five (5) working days of the initial notification attempt, or if the e-mail address or phone number is incorrect, the prize will be forfeited, and a redraw will occur. Valid proof of purchase will be requested to claim the Major Prize. If the winner fails to provide valid proof of purchase the prize will be forfeited, and a redraw will occur. The Promoter may, with the winner's consent, publicly announce the winner's name on the promotion website.

35. The Minor Prize winners will be randomly selected using a pre-selected, random, computer-generated winning timestamp tool.  Provisional winners will be notified immediately on screen upon entry form submission with winner message and monetary value attributed to the win. To redeem the prize, winners must follow the instructions sent to them via email. The Promoter takes no responsibility for errors in email address whilst entering the Promotion.

36. The winner will receive a confirmation email, and their Minor Prize will be sent direct via email within 21 days.

37. Any unclaimed or unredeemed prizes will be forfeited.  There will not be any unclaimed prize draw.

38. The winners have rights under the New Zealand Consumer Guarantees Act 1993 which cannot be excluded or limited by the Promoter.  These rights include statutory guarantees that any goods provided by the Promoter will be of acceptable quality and fit for purpose, and that any services provided by the Promoter will be rendered with due care and skill.  These Terms and Conditions do not, and do not intend to, exclude or limit those statutory rights in any way.  However, to the extent it is permitted by law to do so, the Promoter makes no representations or warranties, express or implied, under laws other than the New Zealand Consumer Guarantees Act 1993 regarding the quality or suitability of the Prize awarded as part of this Promotion and will not be responsible for breach of such representations or warranties.

GENERAL

39. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to or alteration of entries.

40. Entrants must comply with all requirements of the Promoter including requirements specified in the Terms and Conditions. If an entrant enters or attempts to enter the Promotion in a manner, which in the Promoter’s opinion, is contrary to these Terms and Conditions or is fraudulent or unjust to other entrants (such as hacking, cheating, deception, or any other unfair playing practices), the entry may be rejected at the Promoter’s sole and absolute discretion. The Promoter may, at its absolute discretion, declare any or all entries made by an entrant invalid if the entrant:

(a) fails to establish their entitlement to enter the Promotion to the Promoter's satisfaction;

(b) tampers with or benefits from any tampering with the entry process or the operation of the Promotion;

(c) submits an entry which in the Promoter's opinion is not in accordance with these Terms and Conditions;

(d) acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person;

(e) in the opinion of Promoter, engages in conduct in entering the Promotion, which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter;

(f) breaches any law; or

(g) behaves in a way that is otherwise inappropriate.

41. The Promoter collects entrants’ personal information in order to conduct the Promotion. Entry is conditional on providing this information. By entering this Promotion, unless otherwise advised, each entrant agrees that the Promoter may use the entrant’s personal information to conduct the Promotion in accordance with these Terms and Conditions (including to send electronic messages or telephone the entrant in relation to the Promotion).

42. The Promoter may, disclose such information to third parties, including but not limited to agents, contractors, service providers and other suppliers for the purposes of this promotion. The details of winners will be held in accordance with the Coca‑Cola Europacific Partners Privacy Policy that can be accessed by visiting www.ccamatil.com/nz/privacy-policy. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their personal information, how entrants may complain about a breach of the New Zealand Information Privacy Principles or any other applicable law and how those complaints will be dealt with. Winners should direct any request to access, update or correct information to the Promoter at the postal address provided above.

43. If, for any reason beyond the Promoter’s reasonable control, any aspect of the Promotion is not capable or running as planned, or the conduct or operation of the Promotion is interfered with or disrupted in any way (including by vandalism, power failures, natural disasters, acts of God, acts of Government, civil unrest, strikes, tampering, computer bugs or viruses or technical failures), the Promoter reserves the right to, in its sole discretion, cancel, terminate, modify, suspend or recommence the Promotion, or invalidate any affected entries, at any time without prior notice, subject to any applicable law.

44. The Promoter (including its officers, employees and agents) excludes all liability (including negligence) for claims, losses (including loss of opportunity), damages, injuries, costs and/or expenses, whether direct, indirect, special or consequential, suffered, sustained or incurred as a result of, or arising in any way out of, or in any way connected with, the Promotion or any Prize, except for any liability that cannot be excluded by law (in which case that liability is limited to the greatest extent allowed by law)

45. The Promoter is not responsible for any tax implications arising from the winner winning the Prize. Winners should seek independent financial advice.
