FOODMARKS TERMS & CONDITIONS
1. Introduction
These Terms & Conditions (“Terms”) govern your access to and use of the Foodmarks digital ecosystem (“Foodmarks” or the “Platform”), operated by The Coca‑Cola Company and its affiliates (“TCCC,” “we,” “us,” or “our”). These Foodmarks Terms & Conditions (“Foodmarks Terms”) supplement, and are intended to be read together with, the Coca‑Cola Website Terms of Service (“General Terms”). In the event of any conflict, the General Terms will govern except with respect to matters specifically addressed in these Foodmarks Terms, which apply solely to your access to and use of the Foodmarks digital ecosystem.
By accessing or using Foodmarks, you agree to be bound by both the Coca‑Cola Website Terms of Service, and these supplemental Foodmarks Terms.
If you do not agree to these Terms, do not use the Platform.
2. Eligibility & Age Requirements
Foodmarks features rely on geolocation, behavioral signals, and certain engagement tools that may require age‑gating beyond the standard website experience. You may only use Foodmarks if you meet any country‑specific minimum age requirements. TCCC does not knowingly collect personal data from users under the minimum permitted age.
3. Description of Services
Foodmarks is a digital and phygital platform designed to connect consumers with unique food experiences and participating restaurant partners. Through the Foodmarks ecosystem, the platform enables users to:
- Discover curated restaurants, experiences, and food destinations, including locations identified as “Foodmarks” for their cultural, culinary, or experiential significance.
- Access restaurant landing pages, menus, reviews, and storytelling content, including information uploaded through the Restaurant CMS or enriched by Coca‑Cola.
- Participate in missions, activities, challenges, and gamified promotions, which may require check‑ins, visits, digital engagement, or completion of tasks.
- Check in at locations and earn digital rewards, which may be displayed or redeemed through the Foodmarks consumer interface.
- Interact with influencer‑ or creator‑powered content, including social‑led storytelling, video, imagery, or curated itineraries.
- Engage with features hosted across The Coca‑Cola Company’s platforms, including web‑based experiences and other TCCC-supported digital environments.
4. Data Collection & Privacy
Foodmarks may collect data including geolocation, restaurant visit history, food preferences, and social handles where voluntarily provided. The Platform may also enrich restaurant pages using publicly available data from third‑party sources. Please see the Coca‑Cola Global Consumer Privacy Notice for more information.
5. Gamification, Missions & Rewards
Foodmarks may offer challenges, missions, badges, or other reward‑based activities (“Activities”). Participation rules will be outlined for each activation. Coca‑Cola may modify or discontinue missions, badges, or rewards at any time. Rewards may require in‑restaurant validation. By participating, you agree that:
- Activities may have specific eligibility, rules, and deadlines.
- Rewards have no cash value unless explicitly stated.
- Rewards may be modified, discontinued, or revoked at any time.
- TCCC reserves the right to disqualify users for fraud, misrepresentation, or manipulation (including location spoofing).
- Activities will comply with applicable sweepstakes, contest, and promotion laws.
6. Restaurant & Third‑Party Integrations
Foodmarks may also integrate with third‑party technologies including, but not limited to:
- Mapping services (e.g., Google Maps metadata, Mapbox rendering)
- Booking platforms (in future phases)
- Analytics and CRM systems
- Influencer and creator content providers
- Social login and sharing features
Use of these services is subject to the third‑party providers’ terms. Restaurant content may come from participating restaurants or publicly available sources. Restaurants retain ownership of content they submit but grant TCCC a license to display it. You acknowledge that:
- Third‑party terms may apply.
- TCCC is not responsible for availability, accuracy, or performance of third‑party data.
- Your data may be shared with such partners solely to the extent necessary for Platform functionality.
7. AI‑Generated or AI‑Enhanced Content
Foodmarks may generate or enhance certain content using AI tools. Users acknowledge that AI‑generated content may contain inaccuracies. Users may not misuse or manipulate AI systems.
8. Prohibited Conduct
By using the Platform, you agree not to:
- Manipulate or falsify check‑ins, missions, or rewards.
- Upload any unlawful, harmful, defamatory, infringing, or misleading material.
- Disrupt or interfere with Platform operations or security.
- Reverse engineer or scrape Platform functionality.
- Misuse third‑party integrations.
Violations may result in account suspension or termination.
9. Platform Changes
Coca‑Cola may update, expand, or discontinue Foodmarks features at any time, including adding locations, adjusting missions, or introducing new tools.
10. Third‑Party Content & Accuracy
Restaurant information may come from third‑party sources and may not always be accurate. Foodmarks does not endorse or guarantee such information.
The Platform does not guarantee the availability, accuracy, or completeness of third‑party information.
11. Disclaimers
To the fullest extent permitted by law, the Platform is provided “as is” and “as available.” TCCC disclaims all warranties, express or implied, and makes no representations that information (including restaurant listings, mapping data, reviews, or AI‑generated content) is accurate, complete, or current. TCCC is not responsible for disruptions caused by third‑party services, network providers, or outage events.
