Promoter

Competition Period 

12.01am (AEST) on 02/09/2024 to 11.59pm (AEDT) on 10/11/2024.

Who can enter?

Only Australian residents who are aged 15 years or over.

If you are under 18, you must get approval from your parent/guardian before you enter and if you will be under 18 on the date the prize is awarded, it will be awarded to your parent or guardian.  By approving your participation or by accepting any prize on your behalf, your parent or guardian accepts these terms and conditions.

Who can't enter?

Directors, officers, management, employees and contractors (and their immediate families) of:

(a) the Promoter; and

(b) the agencies, companies or participating premises associated with this competition.

Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

Where will the competition run? 

The competition will run in participating retail/grocery (including petrol, convenience and any third party delivery services) stores (Stores) (including the online websites for those Stores) and participating Village, Event or IMAX Sydney Cinemas (Cinemas) in Australia where the below specially marked promotional products are sold (see “Qualifying Purchase” section below).

For clarity, liquor licensed venues and restaurants are excluded.

Qualifying Purchase

In Stores:

Any Fanta pack. Qualifying Purchases may (but does not have to) include any specially marked Fanta Beetlejuice themed product (while stocks last).

In Cinemas, any limited-edition Beetlejuice cup (while stocks last):

  • 32oz Cinema Cup Frozen product: Frozen CocaCola, Frozen Coke Zero Sugar, Frozen Fanta Raspberry, Frozen Fanta Passionfruit and Frozen Fanta Watermelon.

Any Cinema Cup Qualifying Purchase that is purchased in a participating Cinema via App order for that Cinema will be deemed a Qualifying Purchase.

Frozen flavours will vary by location.

Entry instructions

To enter, you must:

(a) make a Qualifying Purchase from a Store or Cinema;

(b) then, during the Competition Period, scan the QR code on the Qualifying Purchase with your smart phone OR visit the Website:

(i) you can choose if you would like to experience the digital “Fanta Afterlife Train”. The “Fanta Afterlife Train” experience is optional and whether or not you participate will not affect your entry and/or chances of winning a prize;

(c) then, locate the entry page and fill out and submit the online entry form to register an account, including by providing the last 4 digits of the Qualifying Purchase barcode (excluding Cinema purchases), the details of where you made your purchase and providing all other requested information to see if you have won an instant prize and to receive 1 entry into the major prize draw.

The Promoter is not responsible if your mobile device/desktop is not sufficiently capable for the purpose of submitting an entry.

For clarity, if you make a Qualifying Purchase from a Village/Event Cinema, you will not be required to provide the last 4 digits of the Qualifying barcode in your entry.

If you have won an instant win prize, you will be requested (on screen) to provide your mailing address (for the Fanta Beetlejuice Bucket Hat prize to be sent to you, if you have won that prize), or you will receive an email with details on how to claim your instant win prize (see “What can I win?” section below for more details).

For Qualifying Purchases from a Coles Store:

If your Qualifying Purchase is from a Coles store or via Coles Online at www.coles.com.au (a Coles Store) (as submitted in your entry form), you will have the chance to win an instant win prize and also be entered into the Coles Exclusive prize draw to have the chance to win the Coles Exclusive prize. You will also receive an entry into the major prize draw.  

For Qualifying Purchases from a Woolworths Store:

If your Qualifying Purchase is from a Woolworths Supermarket in Australia, Woolworths Metro in Australia or via Woolworths Online at www.woolworths.com.au (a Woolworths Store) (as submitted in your entry form), you will have a chance to win an instant win prize and additionally, you will also receive an entry into the Woolworths Exclusive prize draw and also the major prize draw.

For clarity, purchases made from Ampol Woolworths MetroGo, Metro 60, Everyday Market by Woolworths or a Caltex Woolworths/EG Australia store will not qualify for an entry into the Woolworths Exclusive prize draw or an entry into the major prize draw.

For Qualifying Purchases from other Stores/Cinemas:

For clarity, if you make a Qualifying Purchase from a Store (including Coles Stores or Woolworths Stores) or from a Village/Event/IMAX Sydney Cinema, you will have the chance to win an  instant win prize and you will also receive an entry into the major prize draw.

How are instant win prize/s awarded?

All instant win prizes will be determined using a computerised random system at The Coca‑Cola Company, 1 Coca Cola Pl SE, Atlanta, GA 30313, United States of America (The Coca‑Cola Company).

There are up to 3,530 instant win prizes in total  that will be awarded based on random pre-determined set times during the Competition Period as selected by a computerised random system at The Coca‑Cola Company.

How many drawn winners will there be and how will they be chosen? 

There will be 1,131 drawn winners in respect of this competition – 1,100 Woolworths Exclusive prize draw winners, 30 Coles Exclusive prize draw winners and 1 major prize winner.

There will be 3 draws conducted; 1 Woolworths Exclusive prize draw, 1 Coles Exclusive prize draw, 1 major prize draw.

All draws will take place at Handling Matters, Unit 40/1-5 Thew Parade, Cromer NSW 2099 commencing from 12pm (AEDT) on 18/11/2024.

Woolworths Exclusive prize draw:

The first 1,100 valid entries drawn randomly from all of the entries received during the Competition Period where the Qualifying Purchase was made from a Woolworths Store  (including any previous instant winning entries) will each win a Woolworths Exclusive prize.

Coles Exclusive prize draw:

The first 30 valid entries drawn randomly from all of the entries received during the Competition Period where the Qualifying Purchase was made from a Coles Store  (including any previous  instant winning entries) will each win a Coles Exclusive prize.

Major prize draw:

The first valid entry drawn randomly from all of the entries received during the Competition Period (including any previous instant winning entries and/or entries into the Woolworths or Coles Exclusive prize draws) will win the major prize.

The Promoter may draw additional reserve entries in each draw and record them in order, in case a winning entry/entrant is deemed invalid or a prize is unclaimed (Reserve Entrants). 

What can I win?

There are up to 4,661 prizes available – 3,530 instant win prizes, 1,100 Woolworths Exclusive prizes, 30 Coles Exclusive prizes and 1 major prize as follows:

Instant win prizes:

The Promoter is not responsible if you do not receive your preferred colour of the Fanta Beetlejuice Bucket Hat.

If you win the Prezzee e-Gift Card, you will get to choose either a Prezzee e-Gift Card for Adrenaline or an Event Cinemas. However, if you win the Prezzee e-Gift Card and are an ACT resident, you will only win the Adrenaline Prezzee e-Gift card (as Event Cinemas are not available in the ACT).

Any ancillary costs associating with redeeming the Prezzee eGift Card are not included. Redemption of the Prezzee eGift Card is subject to terms and conditions, including validity period, as specified by the card issuer. Any unused balance of the Prezzee Card will not be awarded as cash. Redemption of the Prezzee Card is subject to any terms and conditions of the issuer including those specified on the Prezzee Card. Woolworths Exclusive prizes:

Only available to be won by valid entrants who made their Qualifying Purchase at a Woolworths Store.

If you win a Woolworths Exclusive prize and are an ACT resident, you will receive an alternative prize of a Palace Cinema e-Gift card to the value of $150 to be used at Palace Electric Cinemas, 2 Phillip Law Street, Canberra ACT.

Redemption of the Palace Cinema e-Gift card is subject to terms and conditions, including validity period, as specified by the card issuer. Any unused balance of the Palace Cinema e-Gift card will not be awarded as cash. Valid for 3 years, Palace Cinema e-Gift card can be redeemed online or at any Palace Cinema owned and or operated locations excluding South Australia and Luna Cinemas. Gold Class eVoucher Terms and Conditions:

This eVoucher will expire on the date indicated. This eVoucher entitles the holder to 1x standard Gold Class admission to any session at Event Cinemas or Village Cinemas Gold Class cinema locations. Not valid for use at Moonlight Cinemas or Skyline Drive In. Not valid for use in ACT. Minors must be accompanied by a legal guardian at all times and will not be served alcohol. This eVoucher cannot be redeemed for Original sessions at Event Cinemas, standard sessions at Village Cinemas, Premium Seating concepts, 4DX, ScreenX, IMAX, Boutique, Event Junior, Movie Marathons, Chicks At The Flicks, group bookings or any sessions classified as festivals, alternate content or special events including but not limited to foreign films. Use your eVoucher to book online at eventcinemas.com.au or villagecinemas.com.au (booking fees apply), or present your eVoucher in cinema. Medium Combo eVoucher Terms and Conditions:

This eVoucher will expire on the date indicated. This eVoucher entitles the holder to 1 x Medium Popcorn and 1 x Medium Drink at Event Cinemas, BCC, Greater Union or Village Cinemas Candy Bar or Scoop Alley locations. Not valid for use at Moonlight Cinemas or Skyline Drive In. Not valid for use in ACT. In Cinema redemption only. eVoucher can only be redeemed for the above listed menu items. Additional items must be paid for separately and are the responsibility of the purchaser. The eVoucher must be used on or before the specified expiry date. eVouchers are invalid without an expiry date. Coles Exclusive prizes:

There are 30 Coles Exclusive prizes available to be won.

Only available to be won by valid entrants who made their Qualifying Purchase at a Coles Store.

Each Coles Exclusive prize is a trip for 4 to the Gold Coast, Queensland valued at $3,674. See “Travel prize” section below for further prize details.

Major prize:

There is 1 major prize available to be won.

The major prize is a trip for 2 to Warner Bros. Studios in Hollywood, California valued at up to $15,995 depending on the winner’s point of departure.  See “Travel prize” section below for further prize details.

Travel prize/s

Coles Exclusive prize:

If you win a Coles Exclusive prize, your prize will be an adventure pack for you and 3 companions on the Gold Coast, Queensland which includes the following for you and your companions:

(a) 2 nights’ accommodation at Sea World Resort;

(b) 4 x Theme Park Vouchers (4 day access to Sea World, Movie World and Wet and Wild);

(c) 4 x TopGolf Game Play – per bay for 2 hours; and

(d) 1 x $2,000 Vault Pays-enabled Prepaid Mastercard® for the winner only. 

For clarity, if you win the Coles Exclusive prize, your prize does not include any travel or transfers to or from Queensland or any of the prize activity locations. You are responsible for your own travel/transfer costs.

If you win a Coles Exclusive prize, and you will be under 18 (a Minor) on the date the prize is awarded, the prize will be awarded to your parent or guardian. The parent or legal guardian is responsible for the Minor and must accompany the Minor at all times, including when the Minor takes part in the prize.

Additional Coles Exclusive prize terms and conditions:

  • The Coles Exclusive prize must be booked and taken within 12 months of determination.
  • Accommodation is subject to availability and is valid until 31 August 2025.
  • A surcharge of $200 per night will apply if used during Australian school holidays or Easter.
  • Blackout dates apply between 27 December 2024 – 15 January 2025.
  • No extension to the validity date of this prize will be permitted under any circumstances.
  • Notice of intent to travel must be received at least 30 days prior to the winner’s proposed travel dates.
  • Meals, transport and other incidentals are not included except where specifically stated. 
  • Prize is not transferable or redeemable for cash and all components of the prize must be taken together and booked as one package. 
  • If the winner is under 18 years, the prize may at the absolute discretion of the Promoter and be awarded to the winner’s parent or guardian.
  • Winners are responsible for their own travel insurance.
  • Any alterations to confirmed details within 7 days of arrival will be at the expense of the prize winner.

Any ancillary costs associated with redeeming the Digital Vault Pays-enabled Prepaid Mastercard are not included. The digital Vault Pays-enabled Prepaid Mastercard must be activated within 2 months of issue and is valid for 12 months after activation. At expiry of the Digital Vault Pays-enabled Mastercard any unused balance will be forfeited. Eligible Customers will not receive notice prior to expiry. Card expiry and balance can be found on your mobile device in their digital wallet. The digital Vault Pays-enabled Prepaid Mastercard is issued by EML Payment Solutions Limited (ABN 30 131 436 532) AFSL 404131 pursuant to license by Mastercard. Upon verification, the Vault Pays-enabled Prepaid Mastercard® prize will be sent to the winners by SMS (to the mobile phone number specified on the winner's entry form).  Winners then need to activate the card using the Vault app – activation code will be provided in SMS.  Once activated, the card can be added to the winner's phone’s digital wallet (e.g. Apple Pay, Google Pay or Samsung Pay) and can be used for purchasing goods and services where the card is accepted for electronic transactions (excluding transactions at ATMs or over the counter at financial institutions).  The card cannot be used as a credit card and cannot be linked to any deposit account. 

Major prize:

If you win the major prize, your prize will be a trip for you and 1 adult companion to Warner Brother Studios in Hollywood, California, USA which includes the following for you and your companion:

(a) return economy airfares (including airfare taxes) from your nearest Australian capital city to Los Angeles, California and return private transfers between Los Angeles airport and the accommodation; 

(b) 4 nights’ accommodation in a minimum 4 star hotel, twin share (as determined by the Promoter) including daily breakfast; 

(c) return private transfers from accommodation to Warner Brothers Studios, Hollywood;

(d) 2 x Warner Brothers Studio Deluxe Tour Tickets that includes:

i. Studio Tour Plus experience;

ii. 3 hour guided tour;

iii. 1 hour fine dining and lunch; and

iv. 2 hours for free time & shopping; and

(e) AUD$1,000 spending money for the winner only. Awarded to the winner’s AU bank account.

To take the major prize, you and your companion must have a current and valid passport with at least 6 months validity at the time of travel.

Additional major prize terms and conditions:

  • All travel is subject to availability at all times and may be dependent on select seat class with airlines or specific room category availability with an accommodation partner.
  • Major prize must be redeemed and travel to be taken by 26/11/2025.
  • Block out periods include all Australian School & Public Holidays along with all other special event periods.
  • 2024 Block out dates include but are not limited to: 23rd December – 31st December.
  • 2025 Block out dates include but are not limited to: 1st January – 5th February, 14th April – 25th April, 9th June, 7th – 18th July, 29th September – 10th October, 22nd December – 31st December.
  • All bookings must be made a minimum of 90 days in advance of requested departure dates. All bookings and documentation regarding the major prize must be made via Free-2-Travel Holidays Pty Ltd or their agents. Redeeming the major prize is conditional on acceptance of the terms and conditions of travel as detailed by Free-2-Travel Holidays Pty Ltd and the airline carriers in accordance with normal travel practices. No portion of the major prize is redeemable for cash. The major prize is non-refundable or transferable. In the event the winner is under the age of 18 years, they must be accompanied by a parent/guardian. The major prize winner and their companion must be in possession of a valid passport with a minimum of 6 months validity on it prior to departure. The major  prize winner is responsible for any amendments fees issued by airlines or suppliers once booking is confirmed and ticketed. Winner is responsible for any additional taxes and/or resort fees associated with the chosen accommodation, unless otherwise stated. Visas, valid passports, additional spending money, meals (other than those included) and any other ancillary costs, including but not limited to insurance and any applicable insurance excesses, not listed in the travel prize package descriptions above are the responsibility of the major prize winner and his/her nominated traveling companions as incurred. It is the winner's responsibility to organise transport to/from the airport departure/return point. The major prize winner and travel companions must have valid travel insurance for their period of travel. 

Both travel prizes are subject to any applicable law or guidelines including in relation to a pandemic, any travel/government restrictions/directives, border closures, health advice and the like.

By accepting or participating in any travel prize, your companion accepts these Terms and Conditions.  

Total prize pool

The Instant win prize pool is up to $95,450.

The Woolworths Exclusive prize pool is up to $143,000.

The Coles Exclusive prize pool is $110,220.

The major prize pool is up to $15,995.

The overall total prize pool is up to $364,665.

How many times can I enter?

You can enter up to 5 times in total over the Competition Period.

How and when will the winner/s be informed?

For all instant win prizes, winners will be notified instantly on screen at the time of entering if they have won a prize.

If you have won a Fanta Beetlejuice Bucket Hat prize, you will be requested (on screen) to provide your mailing address for the prize to be sent to you.

If you have won a Woolworths Exclusive or Prezzee eGift Card prize, you will be notified in writing by email within 7 calendar days with details on how to claim your prize.The major prize winner and Coles Exclusive prize winners will be notified by phone and in writing by email within 7 calendar days of determination and will have their last name, first initial and postcode published on the Website on 18/12/2024 for a period of 28 days.

Unclaimed prize/s

There will be no unclaimed instant win or Woolworths Exclusive prizes. Any un-won instant win merchandise prizes or Woolworths Exclusive prizes will be forfeited.

Prezzee eGift Cards and Woolworths Exclusive prizes will be automatically awarded to winners via email to the email address associated with their entry.  It is an entrant's responsibility to ensure that they enter their email address correctly.  If they fail to enter their email address correctly, the prize will be forfeited.

Major prize & Coles exclusive prize claim date: By 5pm (AEDT) on 18/12/2024. 

Major prize unclaimed prize determination: 12pm (AEDT) on 19/12/2024 at the same location as the original draw

Coles exclusive unclaimed prize determination: 12.30pm (AEDT) on 19/12/2024 at the same location as the original draw.

If the major prize has not be accepted or claimed by the prize claim date above or if, after making all reasonable attempts, the Promoter can't contact the major prize winner or the major prize winner does not contact the Promoter) by the prize claim date above, the relevant entry will be discarded and the Promoter will re-award the major prize to a Reserve Entrant and/or carry out unclaimed major prize draw at the date, time and place stated above to award the major prize to a valid entrant.

If a Coles exclusive prize has not been accepted or claimed by the prize claim date above or if, after making all reasonable attempts, the Promoter can't contact an original Coles exclusive winner (or such winner does not contact the Promoter) by the prize claim date above, the relevant entry/ies will be discarded and the Promoter will carry out an unclaimed prize draw at the date, time and place stated above. This unclaimed prize draw will only include valid entries that were received during the Competition Period where the Qualifying Purchase was made from a Coles Store (or via Coles Online).

Any such winner/s will be informed by phone and in writing by email within 7 calendar  days of determination and will also have their last name, first initial and postcode published on the Website on 17/01/2025 for a period of 28 days.

If any prize remains un-won at the end of this competition, or if a prize winner cannot be found, that information will be published on the Website on 20/01/2025.

Collection and use of your personal information

If you are a winner, you and (if applicable) your companion/s must take part in all publicity, photography and other promotional activity as the Promoter requires, without any compensation.  You/your companion/s consent to the Promoter using your name/s and image/s in any promotional or advertising activity.

The Promoter may collect your/your companion/s’ personal information directly or through the Promoter's agents or contractors.  The Promoter will use your/your companion/s’ personal information to conduct and manage the competition. The Promoter may disclose your/your companion/s’ personal information to the Promoter's related companies, agents and contractors to assist in conducting this competition, communicating with you/your companion/s or storing data. This may include disclosures to organisations outside Australia including in places such as New Zealand and Singapore.

If you have marked the “opt-in” box on the entry form, you consent to the Promoter keeping your personal information on its database to use for future marketing purposes, including contacting you by electronic messaging provided that where required by the Spam Act 2003 (Cth), the Promoter includes a functional unsubscribe facility in each direct marketing communication it sends you that you may use to opt-out of any further such communications and provided that the functional unsubscribe facility complies with the Spam Regulations 2021 (Cth). By entering, you consent to receive email or SMS messages from the Promoter without any functional unsubscribe facility if they relate primarily to the conduct of this competition.

The Promoter’s Privacy Policy (see https://www.coca-colacompany.com/au/policies/privacy-policy) includes information about:

(a) how to seek access to the personal information the Promoter holds about you and seek correction of the information; and

(b) how to complain about a privacy breach and how the Promoter will deal with such a complaint.

1 These Terms and Conditions incorporate and must be read together with the details outlined in the table above.  Information about prizes and how to enter forms part of these Terms and Conditions.  By entering, you accept these Terms and Conditions.  

Entry

2 Your entry must be received during the Competition Period and will be deemed to be received only when received by the Promoter. If you return a Qualifying Purchase your entry may be deemed invalid at the Promoter's discretion (unless the product is defective).  You will receive a return message confirming your entry.  The Promoter is not liable for any problems with communications networks outside its reasonable control.  You are responsible for your own costs associated with entering.  If you enter using automatically generated entries or multiple phone numbers/email addresses/addresses/aliases, you may be disqualified. 

Prizes

3 Prizes and all elements of prizes must be taken as specified, as and when offered and cannot be altered or changed in any way by you or will be forfeited, and if forfeited, the Promoter will not be liable.  If you forfeit the prize or any element of the prize for whatever reason, you will not be given cash or any alternative prize as a substitute. Prize/s are subject to any additional terms and conditions imposed by the relevant supplier or the Promoter, including, as relevant:

(a) validity period/s;

(b) booking and availability of flights, accommodation and events;

(c) conditions of travel and conditions of entry into any event venues (including behaviour requirements, health and safety requirements and applicable dress codes);

(d) conditions of ticket validity and any restrictions on ticket on-sale or transfer; 

(e) travel dates and specified travel exclusion periods; 

(f) any additional fees (payable by you) relating to changes made by you/your companion to a travel/event prize after it has been booked; 

(g) the requirement to obtain all necessary documents to travel to any overseas location specified, including a current and valid passport and any visas required;

(h) a requirement to present your credit card when checking in to accommodation; and

(i) a requirement that any person taking the prize that is aged under 18 years old must be accompanied by their parent or guardian at all times.

4 You/your companion/s are responsible for all other unspecified costs related to the prize, including meals, transport, insurance (including excesses), in-room charges, additional taxes, mobile or data plans, etc.  Event tickets can only be used once and will be deemed invalid if copied.  The Promoter does not control entry to the relevant event location. The winner/s must keep their tickets safe and the Promoter will not replace lost or stolen tickets.

5 The Promoter is not responsible for any dispute between you and any person with whom you choose to, or choose not to, share a prize.

6 Subject to the "Travel prizes" section in the table above, the Promoter accepts no responsibility if one or more of the events or activities awarded as part of the prize are abandoned, called off or postponed for any reason.  In that case you and your companion/s forfeit your entitlement to that event/activity.  Unless otherwise specified by the Promoter, you will not be given cash or any alternative prize as a substitute for this altered prize element. 

7 In that case you/your companion/s forfeit your entitlement to that event/activity and the Promoter may provide another item of equal or higher value, subject to any necessary approval by the state/territory gaming authorities. 

General

8 Any material failure by you or (if applicable) your companion/s to comply with the conditions imposed by the prize supplier(s) may result in the prize being cancelled or withdrawn without liability for the Promoter or the prize supplier(s).

9 You and (if applicable) your companion/s accept that some aspects of the prize may be inherently risky and that the prize may involve dangerous activities. 

10 If specified, in order to participate in the activity/activities awarded as part of the prize, you/your companion/s must comply with any applicable conditions (e.g. height, weight, health and fitness requirements).  You must ensure that you/your companion/s are healthy and fit enough to take the prize.  You/your companion/s must follow all requirements of the people responsible for managing the relevant activity/ies.

11 You/your companion/s must, if required by the Promoter, sign disclaimer and release forms provided by the Promoter in favour of the Promoter and other parties before taking the prize.  If you or any companion/s do not sign, your entry will be deemed invalid and you will lose any entitlement to a prize.

12 If you or your entry are deemed by the Promoter to breach these Terms and Conditions materially including if the prize is on set dates and you are unable to take the prize on the relevant date/s, your entry (or at the Promoter's discretion, all of your entries) may be discarded.  The Promoter may, at any time, require you to produce documentation to establish to the Promoter's reasonable satisfaction the validity of your entries and/or verifying your identity (including documentation establishing your identity, age, place of residence and place of employment).  Failure by the Promoter to enforce any of its rights at any stage does not waive those rights.

13 You must not:

(a) tamper with the entry process (including but not limited to manipulating the system via bots, script use, or any other means to circumvent the entry process);

(b) engage in any conduct that may jeopardise the fair and proper conduct of the competition;

(c) act in a disruptive, annoying, threatening, abusive or harassing manner;

(d) do anything that may diminish the good name or reputation of the Promoter or any of its related entities or of the agencies or companies associated with this competition;

(e) breach any law; or

(f) behave in a way that is otherwise inappropriate.  

14 If companion/s can take the prize with you, you are responsible for your companion/s and the Promoter may disqualify all entries from, and prohibit further participation in this competition by, you or any or all of your companion/s if they materially breach these conditions, whether or not legally bound by them.

15 If you (or your companion/s, if applicable), in the reasonable opinion of the Promoter (and/or a medical professional, as relevant to the circumstances), are intoxicated, under the influence of alcohol or any other drug, behave aggressively or offensively, or behave in a manner which may diminish the good name or reputation of the Promoter or any of its related entities or the agencies or companies associated with this competition, is contrary to law or is otherwise inappropriate, the Promoter may cancel the prize or restrict you (and your companion/s) from participating in any elements of the prize, at its discretion.

16 The Promoter is not liable for entries, prize claims or correspondence that are misplaced, misdirected, delayed, lost, incomplete, illegible or incorrectly submitted for reasons outside the Promoter's reasonable control, including failure of any third parties to forward entry forms for inclusion in the draw, where relevant.

17 If any dispute arises between you and the Promoter concerning the conduct of this competition or claiming a prize, the Promoter will take reasonable steps to consider your point of view, taking into account any facts or evidence you put forward, and to respond to it fairly within a reasonable time.  In all other respects, the Promoter’s decision in connection with all aspects of this competition is final.

18 Prizes cannot be transferred or exchanged nor redeemed for cash.  Without limiting any other term of these Terms and Conditions, all prizes (and elements of prizes) must be taken as and when specified, or will be forfeited with no replacement.  The prize values are correct as at the date of preparing these Terms and Conditions and include any applicable GST.  The Promoter is not responsible for any change in prize value.  You agree that if a prize (or element of a prize) is unavailable for any reason the Promoter may provide another item of equal or higher value, subject to any necessary approval by the state/territory gaming authorities.

19 By entering, you request that your full address not be published.

20 Printing and other quality control errors outside the Promoter’s control will not invalidate an otherwise valid prize claim.  Every instant win prize claim in excess of the advertised prize pool will be honoured, unless the claim is rejected due to fraud or ineligibility under these Terms and Conditions.

21 If this competition cannot run as planned for any reason beyond the Promoter's control (for example due to software, hardware or communications issues, unauthorised intervention, tampering, fraud or technical failure, government directives, a pandemic, public health orders and the like), the Promoter may end, change, suspend or cancel the competition or disqualify affected entries/entrants, subject to any necessary approval by the state/territory gaming authorities.

22 The Promoter is not responsible for any tax implications arising from you winning a prize.  You should seek independent financial advice.  If for GST purposes this competition results in any supply being made for non-monetary consideration, you must follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.

Liability

23 You may have consumer rights under statute including under the Competition and Consumer Act 2010 (Cth), which may be relevant to any issue or problem you encounter in relation to this competition and cannot be excluded or restricted.  Nothing in these Terms and Conditions excludes or restricts those rights.  See www.accc.gov.au for more information about those rights.

24 Subject to the previous paragraph, the Promoter and the agencies and companies associated with this competition are not liable (including in negligence) for any loss (including indirect, special or consequential loss or loss of profits), expense, damage, personal injury (including allergies, skin conditions or other reactions, as relevant), illness or death suffered in connection with this competition or any prize, except for any liability which under statute cannot be excluded (in which case that liability is limited to the greatest extent allowed by law).   

25 Without limiting the previous paragraphs, the Promoter and the agencies and companies associated with this competition are not liable for any loss of, damage to or delay in delivery of prize/s, or for any damage that occurs to displayed prize/s (where relevant), due to circumstances beyond the Promoter's reasonable control.  Unless otherwise specified, prize/s will only be delivered to addresses in Australia.

26 This competition is in no way sponsored, endorsed or administered by, or associated with any social media platform, including Facebook, Instagram and Twitter.  You provide your information to the Promoter and not to any social media platform.  You completely release any relevant social media platforms from any and all liability.
