Terms and Conditions

The following terms and conditions (“Terms and Conditions”) apply to the “the Promotion" and by participating in the same you are deemed to have read, understood, and accepted the same.

1. Promoter. Coca‑Cola Namibia Bottling Company (Pty) Ltd and Coca‑Cola Indian Ocean Islands Limited (altogether referred to as the Promoter) are the organisers of this Promotion (“the Promotion”).

2. Participant/s. A person who enters, competes in or is otherwise eligible to win cash prizes and airtime vouchers

3. Eligibility. The Promotion is only open to citizens, permanent residents, or anyone who is legally permitted to reside in the Republic of Namibia and who is 18 (eighteen) years of age or older. Participants must be within the Republic of Namibia at the time of entering the Competition for the verification process and at the time of the prizes being awarded should they be declared a winner, failing which, such person will be disqualified, and the draw of a replacement entry shall take place under the same terms and conditions as the first draw. Any employee, director, partner, immediate family member, agent, consultant or any person directly or indirectly who controls or is controlled by the Promoter and/or The Coca‑Cola Company, their affiliates and related companies, their advertising agencies, advisers, dealers, suppliers, customers or any subsidiary of Coca‑Cola Beverages Africa (Pty) Ltd, its affiliates and/or associated companies are disqualified from participating in the Promotion (collectively, “Disqualified Person/s”). In addition, all Participants must be natural persons; no prize/s will be awarded to any legal entities.

4. Agreement to Terms and Conditions. By entering the Promotion, all participants and the winners agree that they have read and understood these Terms and Conditions (“Terms and Conditions”) and further agree to be bound by these Terms and Conditions as interpreted and applied by the Promoter or its nominated administrator, whose decision regarding any dispute will be final and binding. The Promoter reserves the right at any time  to amend, modify, change, postpone, suspend or cancel the Promotion and any prize/s (which has/have not yet been subject to selection), or any aspect thereof, without notice at any time , for any reason which the Promoter deems necessary and without compensation whatsoever save for any obligation to notify the Lotteries Board of Namibia. The names entered in the Competition must correspond with the names on the identity document and/or passport of the participant.

5. Promotional Period. The Promotion commences at 00H01 on 1st of September 2025 and ends at 23h59 on 30th of November 2025, both days inclusive (“Promotion Period”).  All entries received after the Promotion Period will not be considered. Entries will be deemed to be received at the time of receipt and not at the time of transmission. Entries received will be considered final by the Promoters. Winners of certain prizes will be selected during the course of the Competition Period. All promotional items are subject to availability and while stocks last. The Promoter reserves the right to end the promotion early if stock is depleted.

6. Prize/s.

a. Participants stand the chance of winning the following prizes:

14 x N$ 10 000 cash winners

98 x N$ 5 000 cash winners

220 x N$ 1 000 cash winners

5000 x N$ 30 airtime winners

b. The Promoter shall solely determine the specifications of the Prize/s and the Promoter’s decision shall be final in this regard.

c. The Promoter shall not be liable for any loss to the Prize/s once handed over to the winner/s of the Promotion.

d. Participants acknowledge that there is no guarantee that they will win a prize in this Competition.

7. The Promoters shall not award a Prize to a winner if it is unlawful to supply such Prize to the winner. In such instance, the winner shall immediately forfeit the Prize and be disqualified.

8. The airtime voucher prizes are for different mobile network providers in the Republic of Namibia. Airtime vouchers for some mobile networks may run out quicker than those of the other mobile networks. Once all airtime vouchers for a specific mobile network run out, no more airtime vouchers will be awarded to winners for such mobile network. Winners of airtime will find out instantly if they have won and the reward will be topped up to their device automatically. Each airtime voucher is valid for 30 days from date of issue.

9. All winners are first subject to verification by the promoter and or its nominated administrator, whose decisions are final and binding in all matters related to the promotion. If a participant fails the verification process for whatsoever reason, such person will be disqualified and shall not receive a prize, and a replacement draw, and winner will take place. A participant is not a winner of any prize (whether instant prizes or random draw prizes) even if such participant receives communication indicating that he and/or she is a winner or even if the participant receives email correspondence saying that he and/or she won, unless and until such participant‘s eligibility , and such participant has been verified and such participant has been notified that the verification is complete. The promoter will not accept screen shots or other evidence of winning in lieu of its validation processes.

10. How to Enter.

a. To stand a chance of winning a Prize, participants must buy 1x 2L PET, 1.25lt PET or 600ml PET of any Coca‑Cola products including Coke, Fanta, Sprite, Twist, Sparletta and Stoney (“Participating Product/s”) from any participating retailer (as detailed in Annexure “A” hereto) (“Participating Retailer/s”) during the Promotion Period.

b. Customers buy any 1x 2L PET, 1.25lt PET or 600ml PET participating Coca‑Cola product, including Coke, Fanta, Sprite, Twist, Sparletta and Stoney check under the cap, dial *142*45845# follow the prompts and enter the unique code at N$1.00 per USSD session of 3 minutes.

c. Participants may enter the Promotion as many times as they wish provided; they purchase the Participating Products each time from a Participating Retailer during the Promotion Period.

d. Participants are only eligible to win prizes under this Promotion.  There will be a total of five thousand, three hundred and thirty-two (5332) national winners. 14 x N$ 10 000 cash winners, 98 x N$ 5 000 cash winners, 220 x N$ 1 000 cash winners, 5000 x N$ 30 airtime winners to be won.

e. Participants with valid/invalid codes will receive instant feedback whether they have entered the wrong/invalid code. Correct codes will be automatically entered into the main prize draws.

f. A Participant’s entry will be withdrawn if any Participating Product/s purchased in connection with this Promotion is/are returned.

g. Entries that are unclear, incomplete, inaccurate, erroneous, incomprehensible or illegible, and/or are submitted via an incorrect entry mechanism or contain errors or from Disqualified Person/s will be disqualified.

11. Selection.

a. The Promoter or its nominated administrator’s decision shall be final, and binding and no correspondence will be entered into.

b. The Promoter or its nominated administrator will select the names of the potential winners via random selection of consolidated USSD entries. Winner selection of Promotion will be conducted in weekly random draws of all eligible entries received during the Promotion Period. The draws shall take place on the following dates: 5th of September 2025, 10th of September 2025, 12th of September 2025, 17th of September 2025, 19th of September 2025, 24th of September 2025, 26th of September 2025, 1st of October 2025, 3rd of October 2025, 8th of October 2025, 10th of October 2025, 15th of October 2025, 17th of October 2025, 22nd of October 2025, 24th of October 2025, 29th of October 2025, 31st of October 2025, 5th of November 2025, 7th of November 2025, 12th of November 2025, 14th of November 2025, 19th of November 2025, 21st of November 2025, 26th of November 2025, 28th of November 2025 and 3rd of December 2025

c. Participants whose entries are drawn will be notified via SMS within 1 (one) week from the date of the random draw as to when they will receive their prize. The odds of winning a Prize will depend on the number of eligible entries received during the Promotion Period.

12. Requirements of Potential Winner/s. The Potential winner/s of the Promotion must continue to comply with the Terms and Conditions set out herein.  Winning Prize/s will be contingent upon fulfilling all requirements of the Promotion.  The Promoter will make every reasonable effort to contact the potential winner/s of the Promotion via mobile (SMS), and social media, however, in the event that the Promoters (whether directly or through their agencies) are unable to contact or reach a potential winner for any of the prizes in this Competition, on his or her mobile number used to enter this Competition after drawing his or her entry for whatever reason within 48 hours from the date of the first notification as set out in these Terms and Conditions or if an official winner cannot be contacted within 48 hours from the date of being declared an official winner to arrange the collection or delivery or redemption of the prize as the case may be , or if the winner forfeits the prize for any reason or if the participant is not eligible to enter into this Competition, or if a potential winner fails the verification process after drawing his or her entry for whatsoever reason or if a potential winner or an official winner fails to provide any required information within the timelines stipulated or if a winner refuses to accept a prize or refuses or fails to sign and send to the Promoters the acknowledgement of receipt of the prize, then such person will immediately forfeit their chance to win the Prize or  the Prize and will be immediately disqualified from this Competition and an  alternate potential winner from all remaining eligible entries (up to 3 (three) alternates will be permitted at the discretion of the Promoter or its nominated administrator ) will be drawn, at the discretion of the Promoters or its nominated administrator.  If the alternate potential winner/s are disqualified for whatever reason, the applicable Prize/s will not be awarded, and the Promoters reserve their right to decide what to do with the unawarded prize at their sole and absolute discretion.

13. Publicity. The Promoter may require the prize winner/s of the Coca‑Cola competition to be identified and/or photographed and/or published in printed media and/or appear on radio and/or television, when accepting the Prize/s and/or after having received the Prize/s. The winner/s of the Promotion will be given the opportunity to decline the publication of their image/s and to participate in the Promoter’s marketing material in so far as it relates to the Competition.

Data Protection: To facilitate the Promotion and for marketing communications, the Promoter may process personal information relating to identified or identifiable natural persons, i.e. personal data, who participate in the Promotion. The Promoter will process this personal data in accordance with the Coca‑Cola Privacy Policy – available for review on the Coca‑Cola Company website  https://www.coca-cola.com/xe/en/legal/privacy-policy

14. By entering the promotion, you are consenting to the Promoter processing personal data. You have the right to decline to the processing of your information; however, this may impact dissemination of information in relation to the Promotion. Your rights as a data subject are further outlined in the Coca‑Cola Privacy Policy linked in this clause.

15. General conditions.

a. If the Promoter is unable to reach any Participant via mobile phone, email, social media after drawing his/her entry for whatsoever reason, such Participant will be disqualified from the Promotion and the selection of a replacement entry shall take place in the same manner as the first selection once two weeks from the draw date has elapsed.

b. The Prize/s is/are neither transferable, nor exchangeable for any other item. The Promoter reserves the right to substitute the Prize/s with any other prize/s of comparable commercial value or to vary, postpone, suspend, or cancel the Promotion and the Prize/s (which has/have not yet been subject to selection), or any aspect thereof, with the Lotteries Board of Namibia to be promptly notified of these changes as and when obligated to do so. Winners accept the Prizes on an “as is” basis and do not warrant the Prize’s merchantability or suitability for purpose. The Promoters do not manufacture sell or distribute the Prize and cannot guarantee or warrant their functionality.

c. In the event that the operation, security, or administration of the Promotion is impaired in any way for any reason, including, but, not limited to, fraud, virus or other technical problem, the Promoter may, in its sole discretion, either: (a) suspend the Promotion to address the impairment and then resume it in a manner that best conforms to the spirit of the Terms and Conditions; or (b) cancel the Promotion and award the Prize/s in a random draw from all eligible entries received up to the time of the impairment. The Promoter reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in violation of the Terms and Conditions or the Terms and Conditions of any other promotion, or in an unsportsmanlike or disruptive manner.  Any attempt by any person/s to undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and should such an attempt be made, the Promoter reserves the right to seek damages from any such person/s to the fullest extent permitted by law. 

d. The Promoter's failure to enforce any term of these Terms and Conditions shall not constitute a waiver of that provision.

e. The Promoter reserves the right to carry out audits in respect of any potential winner of the Promotion to verify his/her eligibility and/or the validity of his/her entry.

16. Release and Limitation of Liability. Except where prohibited in law, Participants and/or the winner/s of the Promotion, as the case may be, hereby indemnify the Promoter, its nominated administrator, Coca‑Cola Beverages Africa (Pty) Ltd together with all its subsidiaries and The Coca‑Cola Company, as well as their directors, employees, affiliates, agents, advertising agencies, advisers, suppliers and customers against any and all claims of any nature whatsoever (including consequential and economic loss) arising out of and/or from their participation in any way howsoever in the Promotion including, but not limited to: (a) any act or omission, whether as a result of gross negligence, misrepresentation, misconduct or otherwise; (b) use of the Prize/s; (c) unauthorized human intervention in the Promotion; (d) technical errors related to computers, servers, providers, printers or telephone or network lines; (e) errors in the administration of the Promotion or the processing of entries; and (f) injury or death or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from a Participant’s participation in the Promotion or receipt or misuse of the Prize/s. If, for any reason, a Participant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, such a Participant’s sole remedy shall be another Promotion entry, if it is possible.

17. Consent. All participants and/or winners of the Promotion hereby give their consent to the Promoter to save their cell phone number to the Promoter’s promotional database. This consent can be revoked at any time and participants may decline to receive future marketing communications should they wish.
