TERMS AND CONDITIONS


“SHARE A COKE CAMPAIGN (SAC) 2025”

The "SHARE A COKE (SAC)" campaign is organized by Coca‑Cola Equatorial Africa Limited (CCEAL), located at 6th Floor, Atlantic Towers, Regus Business Center, Airport City, Liberation Road, Accra, Ghana hereinafter referred to as the "Promoter."

The Promoter will be assisted in this campaign by its marketing agency, Echo house Ghana, which will be responsible for the entire campaign.


ARTICLE 1: ELIGIBILITY

The Campaign is only open to permanent residents of the Republic of Ghana with a valid ID card or passport. All participants must be individuals; legal entities are not allowed to participate in this Campaign, and no prize will be awarded to legal entities. Any employee, director, member, partner, agent, or consultant of any of the Promoters, or any person who directly or indirectly controls or is controlled by any of the Promoters, and/or immediate family members of any of the above persons, their advertising agencies, consultants, retailers, suppliers, and beverage bottlers identified by the trademarks owned or licensed by The Coca‑Cola Company, its affiliates, and/or associated companies, are not eligible to participate in this Contest and are therefore disqualified from participating.

Only individuals aged 18 and older may participate in the experiences.

Any participation by a minor or protected adult presumes that they have the necessary permissions. The Promoter may request any minor or protected adult participant to justify such authorization to validate participation or award a prize.

Participation is strictly personal and cannot be made under one or more pseudonyms/profiles, using multiple phone numbers, or from a number registered under a different name.

The Promoter reserves the right to ask any participant to justify the above conditions. Anyone who does not meet these conditions or is unable to justify them will be excluded from the Campaign and will not be able to claim their prize in the event of winning.

The Participant is informed that the personal data collected and processed as part of their registration and participation in the Promotion are necessary for considering their participation in the Promotion.

By entering the Promotion, all participants and winners agree that they have read and understood these terms and conditions ("Terms and Conditions") and further agree to be bound by these Terms and Conditions as interpreted by the Promoter, whose decision in any dispute will be final and binding. The Promoter reserves the right to amend, modify, or change these Terms and Conditions and any prize at any time without notice and to postpone, suspend, or cancel this Promotion and any prize or any aspect of it without notice at any time for any reason the Promoter deems necessary and without compensation. The names entered in the Promotion must match the names on the participant’s identification card and/or passport.


ARTICLE 2: PERIOD

1. Participation for the official launch event of the SAC campaign will be from May 27 to 28 June 2025, at 11:59PM.

2. Entries received after the Launch event  Period will not be considered for the prize.  Entries will be deemed received at the time of their receipt, not the time of transmission. The Promoter will consider entries received as final. Incomplete, inaccurate, unclear, erroneous, illegible, or incomprehensible entries will be deemed invalid and, therefore, disqualified.


ARTICLE 3: CONDITIONS OF PARTICIPATION FOR EVENT

1. The Promoter shall organize a special launch event for the "Share A Coke" (SAC) Campaign, scheduled to take place on June 28, 2025, at Ghud Park, Accra Mall. Participation in this event is subject to the conditions below.

2. All individuals who wish to attend the SAC event must first register via the Promoter’s designated digital platform by scanning a QR Code. This registration process is mandatory and shall require the submission of personal information, including but not limited to full name, contact details, age, and any other information as may be reasonably requested by the Promoter.

3. By registering for the SAC event, each participant expressly consents to the collection, processing, and use of their personal data in accordance with the Promoter’s Privacy Policy and applicable data protection laws. Participation is not permitted without such consent.

4. Upon successful completion of the registration process, each participant will automatically receive a unique alphanumeric code, generated and assigned via the platform. This code will serve as both a confirmation of registration and a participant identifier for the purposes of the prize selection.

5. From among the pool of validly registered participants, the Promoter will randomly select thirty (30) individuals. These individuals shall be referred to as the “Selected Participants.”

6. The Selected Participants shall each receive exclusive access benefits at the SAC event, which may include:

o   Backstage passes to meet select performing artists;

o   The opportunity to take photographs and engage directly with the artists behind the scenes;

o   Special Coca‑Cola branded giveaways and merchandise.

7. The issuance of the unique code and the subsequent selection of winners shall be conducted solely at the discretion of the Promoter, and no correspondence or claims shall be entertained regarding the selection process or outcome.

8. Only individuals aged 18 years and above are eligible to be selected for backstage access and related experiences. The Promoter reserves the right to verify the age and identity of all participants and may request proof of identification prior to awarding any access or prize.

9. Participation in the SAC event, including the registration process and attendance at the venue, shall be undertaken at the participant’s own risk. The Promoter assumes no responsibility for costs incurred, personal injury, or any other claims that may arise in connection with attendance at the event or participation in related activities.

10. The Promoter reserves the right to amend, suspend, or cancel any aspect of the SAC participation mechanics, including but not limited to registration, data collection, code issuance, or winner selection, without prior notice and at its sole discretion


ARTICLE 4: LIABILITY

1. Participation in the SAC Campaign and associated promotional events is voluntary and undertaken at the sole risk of the participant. The Promoter, its affiliates, subsidiaries, bottling partners, appointed agencies, and any other entities involved in the planning, execution, or fulfillment of this Promotion (collectively, the "Released Parties") shall not be held liable for any loss, damage, injury, or disappointment suffered by any participant arising from or in connection with their participation in the Campaign, registration on the platform, attendance at the event, or acceptance and/or use of any prizes or experiences awarded.

2. The Promoter does not guarantee that access to the registration platform or any other technical infrastructure will be uninterrupted or error-free. To the fullest extent permitted by law, the Promoter disclaims any liability for any technical failure, malfunction, or delay of any kind, including but not limited to:

• System errors, server disruptions, delays, or failures in transmission.
•  Internet connectivity issues or data loss.
• Inaccessible, incomplete, or corrupted entries or registrations.
• Any unauthorized access or third-party interference with the SAC registration system.

3. The Released Parties shall not be liable for any indirect, consequential, incidental, or special damages, including loss of opportunity, revenue, or goodwill, even if such damages were foreseeable or if the Promoter was advised of the possibility of such damages.

4. The Promoter shall not be held responsible for any:

• Personal injury, property damage, or death occurring during or resulting from participation in the SAC event;
• Claims related to the inability of a participant to attend the event, use a backstage pass, or receive the prize due to personal circumstances, travel restrictions, health conditions, or force majeure events;
• Misuse or unauthorized disclosure of a participant’s unique code by any third party.

5. All participants and, where applicable, winners, agree to indemnify and hold harmless the Promoter and Released Parties from and against any and all claims, damages, liabilities, costs, and expenses (including legal fees) arising from:

• Any breach of these Terms and Conditions;
• Any act or omission by the participant in connection with their participation in the Campaign;
• The use or misuse of any prize or event access awarded.

6. Participants are advised to take all necessary precautions to safeguard their personal belongings, data, and well-being throughout the Campaign and particularly when attending any physical event organized under this Promotion.

7. Nothing in this Article shall operate to exclude or limit any liability which cannot be excluded or limited by law, including but not limited to liability for death or personal injury caused by negligence or for fraud.


ARTICLE 5: FORCE MAJEURE

Provided that the Participant is informed by any means of the Promoter's choice, the Promoter reserves the right to:

1. Modify these rules during the Promotion.
2. Reduce, extend, suspend, or cancel the Promotion in whole or in part at any time, including if it deems that circumstances require or prevent the normal conduct of the Promotion.
3. Exclude from participation in this Promotion any person who does not comply with these terms and conditions.
4. Cancel the Promotion and its respective prizes if anomalies occur, in any form or origin, particularly technical, related to participation in the Promotion or the determination of Winners, including if one or more elements of the Promotion reveal a disproportionate prize relative to the normal operation of the Promotion.
5. Cancel parts of the Promotion and related prizes if fraud occurs, in any form or origin, in relation to participation in the Promotion or the determination of the Winners.
6. Take legal action against any person who has deceived, defrauded, manipulated, or disrupted the transactions described in these terms and conditions or attempted to do so.

All cases of cancellation and alteration of the Promotion will not give rise to any kind of compensation.

The Promoter will not be held liable if, in the event of force majeure or any other cause beyond its control, the winner is unable to obtain their prize, or if the winner cannot claim the prize immediately. The Promoter reserves the right to shorten, extend, modify, or cancel the Promotion. In the event of postponement or cancellation of the Promotion, the Promoter is not obliged to offer any compensation for prizes that have become obsolete. It cannot be held responsible for these modifications.


ARTICLE 6: PUBLICITY

The Promoter may require that the winners be identified, photographed, and published in print media or appear on radio and television or on social media platforms or other platforms after accepting the prize(s) or after receiving their prize(s). The winners will have the opportunity to refuse the publication of their images and appearing in the Promoter's marketing material, as far as relevant to the Promotion.

By participating in this Campaign, each participant consents to and irrevocably grants the Promoter a worldwide, royalty-free license (free from any other fees or charges), perpetual and non-exclusive, to reproduce, modify, adapt, use, and publish any content placed and/or submitted by the participant on a social media platform related to the Promotion or Prize for any purpose, including promoting the Promoter's products and services or their partner companies, without prior notice or compensation to the Participants. Participants also irrevocably grant the Promoter and Partner Companies a royalty-free, irrevocable, perpetual, and absolute right and license to use, produce, reproduce, modify, publish, and display (including incorporation into other works, in any form, medium, or technology currently known or later developed) the name, image, moving image, video, voice, and/or photograph of a Participant in relation to the Promotion or Prize, including the Participant’s involvement in any aspect of the Promotion or prize, in any advertising, publication, and material in any form or medium worldwide, for advertising and promotional purposes related to this game or any other game organized by the organizing company, without prior notice or compensation to the participants.


ARTICLE 7: ACCEPTANCE OF TERMS AND CONDITIONS

Participation in the Campaign implies acceptance of these terms and conditions in their entirety, as well as ethical standards in force and applicable laws and regulations regarding free games in force in the territory.

Failure to comply with the Promotion participation conditions set out in these terms and conditions will result in the nullity of the participation.

Any claims relating to the interpretation or application of these terms and conditions that cannot be resolved between the parties will be submitted to the court of competent jurisdiction in Ghana.


ARTICLE 8: PERSONAL DATA AND CONFIDENTIALITY

All personal information of Participants will be handled in accordance with the applicable data protection laws and will be subject to the Coca‑Cola Privacy Policy, which will be available on a website for consultation. The Privacy Policy defines how and why personal information is handled. The Coca‑Cola Privacy Policy is an integral part of these Terms and Conditions.

By participating in this promotion, participants acknowledge and understand that: (a) it is mandatory for all participants to provide their personal data to participate in this Promotion, otherwise they will not be able to participate; (b) participants' personal information will be used to process their participation in this Promotion and for additional purposes as detailed in the privacy policy; (c)  Coca‑Cola (including its subsidiaries, bottlers, and joint ventures) may contact participants via email, SMS, social media platforms, and other platforms to send marketing communications regarding its products and promotional activities, subject to the participant's prior consent and in accordance with applicable personal data laws; (d) participants authorize the transfer of their personal data outside the country where the Promotion takes place. Any data transfer to countries that do not offer an adequate level of protection is subject to appropriate safeguards, in accordance with applicable law, to ensure that participants’ personal information is adequately protected, including standards.

The Promoter may require the winners to complete and submit an information disclosure and indemnity agreement to enable the Promoter to ensure compliance with these terms and conditions. If a winner refuses or is unable to comply with this rule for any reason, the winner is deemed to have rejected the Prize, and it will revert to the Promoter.

Participants have rights of access, rectification, deletion, portability, opposition, limitation, and withdrawal of consent or to set guidelines regarding the use of their data under the conditions and limits provided for in the regulations. These rights can be exercised by sending a request to: privacy@coca-cola.com.
