TERMS AND CONDITIONS

 

“THE GHANA WANTA FANTA CAMPAIGN 2025”

The "Ghana Wanta Fanta" campaign is organized by Coca‑Cola Equatorial Africa Limited (CCEAL), located at 6th Floor, Atlantic Towers, Regus Business Center, Airport City, Liberation Road, Accra, Ghana hereinafter referred to as the "Promoter."

The Promoter will be assisted in this campaign by its marketing agency, Echo house Ghana, which will be responsible for the entire campaign.
 

ARTICLE 1: ELIGIBILITY

The Campaign is only open to permanent residents of the Republic of Ghana with a valid ID card or passport. All participants must be individuals; legal entities are not allowed to participate in this Campaign, and no prize will be awarded to legal entities. Any employee, director, member, partner, agent, or consultant of any of the Promoters, or any person who directly or indirectly controls or is controlled by any of the Promoters, and/or immediate family members of any of the above persons, their advertising agencies, consultants, retailers, suppliers, and beverage bottlers identified by the trademarks owned or licensed by The Coca‑Cola Company, its affiliates, and/or associated companies, are not eligible to participate in this Contest and are therefore disqualified from participating.

Only individuals aged 18 and older may participate in the experiences. 

Any participation by a minor or protected adult presumes that they have the necessary permissions. The Promoter may request any minor or protected adult participant to justify such authorization to validate participation or award a prize.

Participation is strictly personal and cannot be made under one or more pseudonyms/profiles, using multiple phone numbers, or from a number registered under a different name.

The Promoter reserves the right to ask any participant to justify the above conditions. Anyone who does not meet these conditions or is unable to justify them will be excluded from the Campaign and will not be able to claim their prize in the event of winning.

The Participant is informed that the personal data collected and processed as part of their registration and participation in the Promotion are necessary for considering their participation in the Promotion.

By entering the Promotion, all participants and winners agree that they have read and understood these terms and conditions ("Terms and Conditions") and further agree to be bound by these Terms and Conditions as interpreted by the Promoter, whose decision in any dispute will be final and binding. The Promoter reserves the right to amend, modify, or change these Terms and Conditions and any prize at any time without notice and to postpone, suspend, or cancel this Promotion and any prize or any aspect of it without notice at any time for any reason the Promoter deems necessary and without compensation. The names entered in the Promotion must match the names on the participant’s identification card and/or passport.
 

ARTICLE 2: CAMPAIGN PERIOD

1. The Campaign will run from the February 20, 2025, to March 31, 2025, at 11:59 PM.

2. Entries received after the Campaign Period will not be considered. Entries will be deemed received at the time of their receipt, not the time of transmission. The Promoter will consider entries received as final. Incomplete, inaccurate, unclear, erroneous, illegible, or incomprehensible entries will be deemed invalid and, therefore, disqualified.
 

ARTICLE 3: CONDITIONS OF PARTICIPATION

1. The Promoter will create collection sites which will have collection bins/points. These collection sites will be announced to the public by the Promoter. To be a part of this campaign, Participants must carry out the following steps: 

i. Collect a mix of all Fanta SKU bottle caps/ covers and place them in a Ziplock bag or any transparent bag with their name and contact detail labeled eligibly on it and take it to the collection sites.

ii. Scan the QR Code on the Collection bins and register on the Promoter’s One XP Platform. By registering on the platform, participants get access to the pop-up event and the Wanta Fanta main event.

iii. Drop the Fanta bottle caps/covers in the collection bins. Participants who submit 3 bottle caps and above, stands the chance to win a prize during the lucky draw holding on the Wanta Fanta main event day on the 6th of April 2025.

1. Winners of the raffle draw will be announced on the Wanta Fanta main event day during the raffle draw.

2. Prize collection will be at the main Wanta Fanta event day grounds.

3. Prizes are personal and non-transferable and cannot be exchanged or substituted for cash or any other product or service.
 

ARTICLE 5: LIABILITY

Participation in the Promotion is the sole responsibility of each Participant.

The Promoter does not guarantee that the Promotion will operate without interruptions, failures, or malfunctions, or the absence of IT or other errors, or that any defects found will be corrected, which the participant expressly acknowledges.

The Promoter expressly declines all responsibility for any incidents or damages of any kind that may occur because of receptor use of the prize, which the Participants who win expressly accept.

The Promoter cannot be held responsible for any material or immaterial damage caused to the participants, their materials and equipment, or the data stored therein, or for any direct or indirect consequences arising from this, namely in their personal, professional, or commercial activity, as well as damages of any kind (personal, physical, material, financial, or other) that occurred during participation in the Promotion. Participants are invited to take all necessary precautions regarding their equipment and data.

All participants and winners, as applicable, indemnify the Promoter/Sponsoring Company, the advertising agencies, consultants, designated agents, partners, suppliers, and licensees of beverages identified by trademarks owned or licensed to The Coca‑Cola Company, affiliates, and/or associated companies from and against any claim of any kind arising from their participation in this Contest  in any way (including as a result of any act or omission, whether as a result of negligence, misrepresentation, misconduct, or otherwise by the Promoter and/or receipt and/or use of the prize).
 

ARTICLE 6: FORCE MAJEURE

Provided that the Participant is informed by any means of the Promoter's choice, the Promoter reserves the right to:

1. Modify these rules during the Promotion.

2. Reduce, extend, suspend, or cancel the Promotion in whole or in part at any time, including if it deems that circumstances require or prevent the normal conduct of the Promotion.

3. Exclude from participation in this Promotion any person who does not comply with these terms and conditions.

4. Cancel the Promotion and its respective prizes if anomalies occur, in any form or origin, particularly technical, related to participation in the Promotion or the determination of Winners, including if one or more elements of the Promotion reveal a disproportionate prize relative to the normal operation of the Promotion.

5. Cancel parts of the Promotion and related prizes if fraud occurs, in any form or origin, in relation to participation in the Promotion or the determination of the Winners.

6. Take legal action against any person who has deceived, defrauded, manipulated, or disrupted the transactions described in these terms and conditions or attempted to do so.

All cases of cancellation and alteration of the Promotion will not give rise to any kind of compensation.

The Promoter will not be held liable if, in the event of force majeure or any other cause beyond its control, the winner is unable to obtain their prize, or if the winner cannot claim the prize immediately. The Promoter reserves the right to shorten, extend, modify, or cancel the Promotion. In the event of postponement or cancellation of the Promotion, the Promoter is not obliged to offer any compensation for prizes that have become obsolete. It cannot be held responsible for these modifications.
 

ARTICLE 7: PUBLICITY

The Promoter may require that the winners be identified, photographed, and published in print media or appear on radio and television or on social media platforms or other platforms after accepting the prize(s) or after receiving their prize(s). The winners will have the opportunity to refuse the publication of their images and appearing in the Promoter's marketing material, as far as relevant to the Promotion.

By participating in this Campaign, each participant consents to and irrevocably grants the Promoter a worldwide, royalty-free license (free from any other fees or charges), perpetual and non-exclusive, to reproduce, modify, adapt, use, and publish any content placed and/or submitted by the participant on a social media platform related to the Promotion or Prize for any purpose, including promoting the Promoter's products and services or their partner companies, without prior notice or compensation to the Participants. Participants also irrevocably grant the Promoter and Partner Companies a royalty-free, irrevocable, perpetual, and absolute right and license to use, produce, reproduce, modify, publish, and display (including incorporation into other works, in any form, medium, or technology currently known or later developed) the name, image, moving image, video, voice, and/or photograph of a Participant in relation to the Promotion or Prize, including the Participant’s involvement in any aspect of the Promotion or prize, in any advertising, publication, and material in any form or medium worldwide, for advertising and promotional purposes related to this game or any other game organized by the organizing company, without prior notice or compensation to the participants.
 

ARTICLE 8: ACCEPTANCE OF TERMS AND CONDITIONS

Participation in the Campaign implies acceptance of these terms and conditions in their entirety, as well as ethical standards in force and applicable laws and regulations regarding free games in force in the territory.

Failure to comply with the Promotion participation conditions set out in these terms and conditions will result in the nullity of the participation.

Any claims relating to the interpretation or application of these terms and conditions that cannot be resolved between the parties will be submitted to the court of competent jurisdiction in Ghana.
 

ARTICLE 9: PERSONAL DATA AND CONFIDENTIALITY

All personal information of Participants will be handled in accordance with the applicable data protection laws and will be subject to the Coca‑Cola  Privacy Policy, which will be available on a website for consultation. The Privacy Policy defines how and why personal information is handled. The Coca‑Cola  Privacy Policy is an integral part of these Terms and Conditions.

By participating in this promotion, participants acknowledge and understand that: (a) it is mandatory for all participants to provide their personal data to participate in this Promotion, otherwise they will not be able to participate; (b) participants' personal information will be used to process their participation in this Promotion and for additional purposes as detailed in the privacy policy; (c)  Coca‑Cola (including its subsidiaries, bottlers, and joint ventures) may contact participants via email, SMS, social media platforms, and other platforms to send marketing communications regarding its products and promotional activities, subject to the participant's prior consent and in accordance with applicable personal data laws; (d) participants authorize the transfer of their personal data outside the country where the Promotion takes place. Any data transfer to countries that do not offer an adequate level of protection is subject to appropriate safeguards, in accordance with applicable law, to ensure that participants’ personal information is adequately protected, including standards.

The Promoter may require the winners to complete and submit an information disclosure and indemnity agreement to enable the Promoter to ensure compliance with these terms and conditions. If a winner refuses or is unable to comply with this rule for any reason, the winner is deemed to have rejected the Prize, and it will revert to the Promoter.

Participants have rights of access, rectification, deletion, portability, opposition, limitation, and withdrawal of consent or to set guidelines regarding the use of their data under the conditions and limits provided for in the regulations. These rights can be exercised by sending a request to: privacy@coca-cola.com.
