Terms and Conditions
1. Eligibility: The Sprite ICC T20 World Cup 2024 Promotion, (“Promotion”) is open only to residents of the Islamic Republic of Pakistan (“Pakistan”) who are 18 years of age or older at the time of entry. Employees and non-employee workers of The Coca‑Cola Export Corporation- Pakistan Branch (“Company”), Coca‑Cola Beverages Pakistan Limited (“Bottler”), and their respective parent companies, subsidiaries, affiliates, agents and those prize providers and agencies that are involved in the development or execution of this Promotion or any of its materials, and the immediate family (spouse, parents, siblings, and children) and household members of each such person are not eligible. This Promotion is subject to all applicable laws of Pakistan.
2. Agreement to Terms and Conditions: By participating in this Promotion, each of the participants, agree, confirm and declare, that he has read these Promotion General Terms and Conditions collectively the “Terms and Conditions”.
By participating in this Promotion, each of the participants fully and unconditionally agree to and accept these Terms and Conditions including any modifications, revisions and amendments thereto. The decision of the Company is final and binding in all matters related to this Promotion. Further, the participants recognize that these Terms and Conditions may be modified by the Company from time to time without any prior notice by posting the applicable terms and conditions on the Promotion Website. The Company also reserves the right to cancel or terminate this Promotion at any stage without assigning any reasons whatsoever. Successfully entering this Promotion and winning a prize is subject to all requirements set forth herein. These Terms and Conditions will be hosted at Company website (“Promotion Website”).
3. Promotion Period: This Promotion begins 27 May 2024 and ends 30 June 2024 or completion of three million entries in the Promotion whichever comes first (the “Promotion Period”). The Company may alter the Promotion Period, extend, shorten or cancel this Promotion altogether, in accordance with updates to be published by the Company and/or any of its representatives on the Promotion Website.
4. How to Enter:
(a) Find the Code: During the Promotion Period, a code (“Code”) would be printed on the promotional yellow closures/caps of 55 Million physical bottles available to purchase in Pakistan to participate in this Promotion. Once participant purchases any of the following Products, namely, Sprite 350ml, Sprite 500ml, Sprite 1L, Sprite 1.5L, Sprite Lemon & Mint 350ml, Sprite Lemon & Mint 500ml, Sprite Lemon & Mint 1L, Sprite Lemon & Mint 1.5L, Fanta 500ml, Fanta 1L, Fanta 1.5L bottles having yellow closures/caps “Promo Packs”, the Code needs to be sent by WhatsApp message to +92-322-2777483)
(b) Limit: Multiple participants are not permitted to share the same mobile phone number. A Code can only be used once to enter the Promotion. A participant can take part in this Promotion any number of times using a new Code each time. A participant can only be declared successful one time a day but can only win the Bumper Prize below only once. Any attempt by any participant to obtain more than the stated number of entries by using multiple/different mobile phone numbers, identities, registrations or logins, or any other methods will void that participant’s entries and that participant may be disqualified. Any use of robotic, repetitive, automatic, programmed, or similar entry/play methods or agents (including, but not limited to, sweepstakes entry services) will void all entries by that participant. In the event of a dispute as to any online entry/play, the authorized account holder of the mobile phone number used to enter/play will be deemed to be the participant. The "authorized mobile number holder" is the natural person assigned a mobile phone number by an Internet access provider, online service provider or other organization responsible for assigning mobile phone numbers in Pakistan. Potential winners may be required to show proof of being authorized mobile number holders.
5. Prize: Subject to the terms and conditions, each participant sending a valid Code, may win any one of the following Prizes:
(a) Bumper Prize: Trip for one (1) person to the Final of the ICC T20 World Cup 2024 in Barbados (“Bumper Prize”).
• This Bumper Prize will only be available for 29 days of the Promotion Period, that is, from 27 May 2024 to 25 June 2024. A total of 20 winners shall be selected during this duration from 27 May 2024 to 25 June 2024
• One (1) trip package valid for one (1) person to travel to Barbados, to attend and watch the Final of the ICC T20 World Cup 2024. The Bumper Prize includes (i) one (1) air ticket for one person for a round trip from Pakistan to Barbados (ii) one hotel room sharing or individual basis as determined by the Company (iii) transportation from hotel to ICC T20 World Cup 2024 match location and to/from airport in Barbados (iv) one (1) ticket to attend and watch the Final of the ICC T20 World Cup 2024 match. The trip package/travel route will be a group booking and is fixed and deviations will not be allowed. Obtaining the visa and visa clearance is a sole responsibility of the winner of the Bumper Prize.
In the event any winner of the Bumper Prize is unable to travel to Barbados for any reason (not having passport or visa), the Company may, at its sole discretion, give such winner a cash prize of PKR 500,000/-
(b) Coca‑Cola Merchandises (namely Bats, Gymbags, T-Shirts, String Bags, Balls, Caps, Stickers, Flasks, Keychains )
• Winners of ‘Coca‑Cola Merchandises’ will be contacted by the Company’s representative and the prizes will be delivered to the home addresses in Pakistan.
• All the winners need to ensure that they provide their complete and correct address
6. Prize Conditions and Restrictions:
• For Bumper Prize: Trip for one (1) person to attend and watch the Final of the ICC T20 World Cup 2024 in Barbados.
All other expenses other than what is explicitly mentioned as included, shall be borne by the winner. VISA for the winner shall be his/her own responsibility. His/her winning is subject to completing additional legal and travel documentation and securing the necessary travel permissions, including a valid passport, a visa to travel to Barbados (or any other transit visa), for him/her. Any applicable taxes and fees associated with the Bumper Prize and its use thereof shall be winner’s responsibility and shall be to the account of the winner. The Company reserves the right to cancel/modify such trip at its sole discretion.
• Codes cannot be combined with other promotions, cashed in, exchanged, transferred, assigned, used as a deposit, or transferred to any account as a payment. Each promotional yellow closure/cap is for single use and cannot be used for commercial purposes. Participants may not benefit from the Promotion if they enter the Code at the Promotion Website or WhatsApp after the end of the Promotion Period.
• Prizes are subject to availability. No substitution, exchange, or transfer of any prize by any winner. The Company reserves the right to substitute any prize for another at the sole discretion of the Company. Winners are responsible for all taxes and fees associated with prize receipt and/or use and shall be to the account of the winner. The Company expressly disclaim any warranties, express or implied in connection with any prizes to the fullest extent permitted by applicable laws. It is a condition of entry that the winner may be required to execute deed of acknowledgement, release and indemnity in a form prescribed by the Company and any other document required by the Company in its sole discretion.
• All potential recipients of the Bumper Prize are subject to verification by the Company, whose decision is final and binding in all matters related to this Promotion. A participant is not a recipient even if participant receives a confirmation saying he or she won, unless and until participant’s eligibility, and the potential recipient have been verified and participant has been notified that verification is complete. Any entry that is received after the prize system has failed for any reason is deemed a defective entry, is void, and will not be honored.
• In case of suspicion, the Company has the right to ask for the location from which the product was purchased and request the promotional yellow closure/cap. Therefore, it is recommended that participants keep the promotional yellow closure/caps after entering the Code to the WhatsApp chat (0322-2777483) until receiving the prize as a precaution so as to prove that they have legitimately won the prize. In cases of suspicion, the Company has the right to ask participants for additional information and documents. The Company reserves the right to hold back the prize if the requested information and documents are not provided by the participant, or the provided information and documents are found suspicious/incomplete. In case of any suspicion of misuse, the Company reserves the right to ban the relevant sales point and/or consumer from the Promotion, limit their right to benefit from the Promotion and take other measures.
7. Promotion Prize Selection and Verification of Potential Recipients: Potential recipients must comply with all terms and conditions of these Term and Conditions. Winning is contingent upon fulfilling all requirements. The Company is an independent judging organization whose decisions as to the administration and operation of this Promotion and the selection of potential recipient are final and binding in all matters related to this Promotion.
8. Data Usage:
(a) Each participant hereby agrees and confirms, that his/her participation in and/or winning the prize, may be covered, filmed, photographed, and broadcasted on the media, including television, billboards, printed press, websites, social media and that by his/her very participation in this Promotion, the participant hereby expresses his/her consent and authorizes the Company, without receiving (or expecting) any compensation, to the publication and/or filming of his/her name, photos and video as part of said coverage and publications, including as part of the Company’s publications and sales promotions on any media including print, social media, television, cable, satellite channels in and outside Pakistan (where not prohibited by written law), and to the use of statements of the participant as part of the Promotion. Also the Company and its designees may use the participant’s details for contacting him/her for any future promotions/offers. By entering into this Promotion, each participant agrees to be bound by the Privacy Policy/Notice and agree to receive marketing and promotional material from the Company
(b) Participants must read and accept the Privacy Policy/Notice containing detailed information about the collection, processing, and storage of personal data, in order to participate in this Promotion
(c) Personal data of participants who tick the box under the Company’s communication form, which certifies that they give consent for receiving commercial electronic messages, may be collected, processed, and stored, and they may receive information about products, promotions, or campaigns. Commercial electronic permission can be withdrawn at any time.
9. General Conditions: In the event that the operation, security, or administration of this Promotion is impaired in any way for any reason, including, but, not limited to, fraud, technical failures, regularly-scheduled maintenance, virus or other technical problem, the Company may, in its sole discretion, either: (a) suspend this Promotion to address the impairment, then resume this Promotion in a manner that best conforms to the spirit of these Term and Conditions; or (b) cancel this Promotion and award the prizes in a random drawing from among all eligible entries received up to the time of impairment. The Company reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of this Promotion or to be acting in violation of the Term and Conditions of this Promotion, or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of this Promotion may be a violation of criminal and civil law, and, should such an attempt be made, the Company reserves the right to seek damages from any such person to the fullest extent permitted by law. The Company’s failure to enforce any term of these Term and Conditions shall not constitute a waiver of that provision.
10. Release and Limitations of Liability: Except where prohibited, by participating in this Promotion, participants agree to release and hold harmless the Company, the Bottler, and their respective parents, subsidiaries, affiliates, Promotion partners, prize partners, agents and agencies, and the officers, directors and employees of each of them (the “Released Parties”) from and against any claim or cause of action arising out of participation in this Promotion or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in this Promotion; (b) technical errors related to QR Code, computers, servers, providers, printers or telephone or network lines; (c) printing errors; (d) errors in the administration of this Promotion or the processing of registrations; (e) late, lost, or undeliverable mail; (f) failure to award any component of a prize due to the occurrence of any public health emergency; or (g) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from participant’s participation in this Promotion and (h) for any reasons beyond the control of the Released Party. Participant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Promotion and in no event shall the Released Parties be liable for attorney’s fees. Participant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth herein to be available and/or claimed, the Company reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.
The Promotion and the terms and conditions shall be governed by the laws of the Islamic Republic of Pakistan.
11. Disputes: Participant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prizes awarded shall be resolved individually, without resort to any form of class action, and exclusively through Arbitration under the Arbitration Act 1940 and the rules made thereunder; and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering any Promotion, but in no event attorneys' fees. All issues and questions concerning the construction, validity, interpretation and enforceability of these Term and Conditions, or the rights and obligations of the entrant and the Company in connection with this Promotion, shall be governed by, and construed in accordance with, the federal laws of Pakistan, without giving effect to any choice of law or conflict of law rules (whether of Pakistan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the federal laws of Pakistan.
