Biometric Information Policy

Effective Date: 5 May 2023

This Biometric Information Policy applies to consumers who choose to participate in the Coke Creations Ultimate You Experience (the Ultimate You Experience) offered by The Coca‑Cola Company and its affiliates (Coca‑Cola) and are legal residents of the Participating Markets (defined below). This Biometric Information Policy supplements but does not replace our Privacy Policy – it applies to Biometric Information collected in connection with the Ultimate You Experience.

BY PARTICIPATING IN THE ULTIMATE YOU EXPERIENCE YOU ACKNOWLEDGE, AGREE AND CONSENT TO THE TERMS OF THIS BIOMETRIC INFORMATION POLICY. IF YOU DO NOT ACKNOWLEDGE, AGREE AND CONSENT, YOU MAY NOT PARTICIPATE.

What is Biometric Information?

In this Biometric Information Policy, Biometric Information means information that is technologically extracted from a facial scan made through the Ultimate You Experience and that identifies or can be used to identify you. A photograph of you is not Biometric Information, but Biometric Information can include data that identifies you extracted from a photograph by technical means.

Why is Biometric Information Collected?

To participate in the Ultimate You Experience, you must consent to collection and use of your Biometric Information by Coca‑Cola and the technology and other service providers working on Coca‑Cola’s behalf to make the Ultimate You Experience available for you. We use this Biometric Information to digitally convert the facial scan into an avatar (Avatar) and a short video for you to download and share.

We use your Biometric Information only for these purposes, or as otherwise required by law. Coca‑Cola does not collect, use, store, or disclose your Biometric Information without your consent.

If you choose not to provide this consent, please exit the Ultimate You Experience. Alternately, you can return to the home page and participate in the Ultimate You Experience designed for users under the age of 18.

The Ultimate You Experience is only available for residents of the following jurisdictions (Participating Markets) who are at least age 18 (or the age of majority if older):

Does Coca‑Cola share Biometric Information?

Unless otherwise required by law, your Biometric Information is accessible only to Coca‑Cola and our service providers that must process your Biometric Information on our behalf to enable your participation in the Ultimate You Experience. We do not share Biometric Information with other third parties unless required by law. We do not sell, lease, trade or otherwise profit from your Biometric Information.

We may disclose your Biometric Information to our authorized service providers or other third parties only if:

  • You or your authorized representative consent to the disclosure;
  • the disclosure is required pursuant to a valid warrant, subpoena, or court order issued by a court of competent jurisdiction; or
  • the disclosure is required by law.

How does Coca‑Cola protect and store Biometric Information?

Coca‑Cola stores and protect your Biometric Information using a reasonable standard of care that is at least as protective as the way Coca‑Cola collects, stores, transmits, and protects other confidential and sensitive personal information. Coca‑Cola requires that its service providers protect Biometric Information to this same standard.

Unless otherwise required by an order from a court of competent jurisdiction or applicable law, Coca‑Cola will only retain Biometric Information until the earlier of: (i) the initial purpose for collecting the Biometric Information – creating your avatar for your participation in the Ultimate You Experience – is complete or (ii) no later than December 31, 2023, unless legally required to keep it for a different period. Thereafter, Coca‑Cola will and will require its service providers to securely and permanently destroy the Biometric Information using industry standard practices.
