Terms and Conditions: Coke Studio™ Promotional Competition
1. Promoters: This Coke Studio™ Promotional Competition (“Competition”) is organised by Coca‑Cola Africa (Proprietary) Limited (“CCA”), Expanding Branding (Proprietary) Limited and VPAS Idea Merchants CC (“VPAS”) (“Promoters”).
2. Eligibility: The Competition is only open to permanent residents and citizens of the Republic of South Africa of the age of 18 (eighteen) years or older, living in South Africa and in possession of a valid form of identification (South African Identity Document or Passport). All participants must be natural persons; legal entities cannot participate in this Competition and no prize/s will be awarded to any legal entities. Any minor, or any employee, director, member, partner, agent or consultant of any of the Promoters, or any person who directly or indirectly controls or is controlled by any of the Promoters and/or immediate family members of any of the above persons, its advertising agencies, advisers, dealers, suppliers and bottlers of beverages identified by the trademarks owned by or licensed to The Coca‑Cola Company, its affiliates and/or associated companies, is not eligible to participate in this Competition and is therefore disqualified from participating in this Competition.
3. Agreement to these Terms and Conditions: By entering the Competition, all participants and the winner agree that they have read and understood these terms and conditions (“Terms and Conditions”) and further agree to be bound by these Terms and Conditions as interpreted by the Promoters, whose decision regarding any dispute will be final and binding. The Promoters reserve the right at any time, without notice, to amend, modify, or change these Terms and Conditions and any prizes, and to postpone, suspend or cancel this Competition and any prizes, or any aspect thereof, without notice at any time, for any reason which the Promoters reasonably deem necessary and without any compensation whatsoever. The names entered in the Competition must correspond with the names on the identity document and/or passport of the participant.
4. The Competition is only valid within South Africa. Participants must be within South Africa at the time of entering the Competition, for the verification process and at the time of the prizes being awarded should they be declared a winner, failing which such person will be disqualified and the draw of a replacement entry shall take place under the same terms and conditions as the first draw.
Competition Period:
5. The Competition commences at 00h01 on 07 August 2023 and ends at 23h59 (South African time) on 31 December 2023(the “Competition Period”). Entries received after the Competition Period will not be considered. Entries will be deemed to be received at the time of receipt and not at the time of transmission. Entries received will be considered final by the Promoters. Incomplete, inaccurate, unclear, erroneous, ineligible or incomprehensible entries will be deemed invalid and thus disqualified.
6. Description of Prize/s:
Prizes are tiered and for consumers to qualify for a specific tier of prizes they must have submitted the minimum number of valid purchases of participating products as described in paragraph 9 below required to be eligible for each specific prize tier. Participants stand a chance to win:
a. Tier 1 (8 valid purchases to qualify):
i. 1 of 90 JBL Portable Party Box Speaker and JBL Wireless Mic, model number OH4375 valued at R5 750.00 (five thousand seven hundred and fifty rand) each (“ Speaker Prize”); or
ii. 1 of 50 double tickets to HeyNeighbour Festival 2023 in South Africa (General weekend access, all 3 days inclusive from 8th December 2023 to 10th December 2023.) valued at R4199.00 (four thousand one hundred and ninety-nine rands). This prize solely consists of the tickets to attend the HeyNeighbour Festival event. All expenses, travel, accommodation, meals, other arrangements and costs are not included in the prize and are the sole responsibility of the winner (“HeyNeighbour Festival General Weekend Ticket Prize”); or
iii. 1 of 25 double tickets to HeyNeighbour Festival 2023 in South Africa (VIP weekend access all 3 days inclusive from 8th December 2023 to 10th December 2023) valued at R5199.00 (five thousand one hundred and ninety-nine rands). This prize solely consists of the tickets to attend the event. All expenses, travel, accommodation, meals, other arrangements and costs are not included in the prize and are the sole responsibility of the winner (“HeyNeighbour Festival VIP Weekend Ticket Prize”); or
b. Tier 2 (5 valid purchases to qualify):
i. 1 of 80 AirPods Gen3 Wireless valued at R4 000,00 (four thousand Rands) each (“AirPods Gen3 Wireless Prize”); or
ii. 1 of 80 Beats Studio Buds (earbuds) valued at R2 700,00 (Two thousand seven hundred Rands) each (“Beats Studio Buds Prize”); or
iii. 1 VIP double ticket to DSTV Delicious Festival 2023 (The Delicious Terrace Lounge) valued at R3600.00 (three thousand six hundred rands). This prize solely consists of the tickets to attend the event. All expenses, travel, accommodation, meals, other arrangements and costs are not included in the prize and are the sole responsibility of the winner (“DSTV Delicious Festival VIP Ticket Prize”); or
iv. 1 of 25 double tickets to HeyNeighbour Festival 2023 in South Africa (VIP Single Day access. 5 double tickets for Friday 8th December, 10 double tickets for Saturday 9th December 2023 and 10 double tickets for 10th December 2023) valued at R2199.00 (two thousand one hundred and ninety-nine rands). This prize solely consists of the tickets to attend the event. All expenses, travel, accommodation, meals, other arrangements and costs are not included in the prize and are the sole responsibility of the winner (“HeyNeighbour Festival VIP Single Day Ticket Prize”); or
c. Tier 3 (3 valid purchases to qualify):
i. 1 of 200 JBL Tune 770 Noise Cancelling Headphones valued at R1 840,00 (one thousand eight hundred and forty Rand) each (“JBL Tune 770 Prize”); or
ii. 1 of 70 Hisense 2.1CH BT Sound Bar HS2100 valued at R2799.00(two thousand seven hundred and ninety-nine) each (“Hisense Soundbar and Sub Prize”); or
iii. 1 of 100 Sony Portable Wireless Speaker SRS-XE200 valued at R1 955,00 (one thousand nine hundred and fifty- five Rand) each (“Wireless Speaker Prize”); or
iv. 1 of 80 Coke Studio limited edition hoodies valued at R800.00 (eight hundred rands) each (“Hoodies Prize 1”); or
v. 1 of 80 Coke Studio limited edition hoodies valued at R1 200.00 (one thousand, two hundred rands) each (“Hoodies Prize 2”); or
vi. 1 of 75 Coke Studio limited edition puffer jacket and red T-Shirt valued at R1001.96 (one thousand and one rand and ninety-six cents) each (“Combo 5 Limited Edition Merch Prize”); or
vii. 1 of 75 Coke Studio limited edition puffer jacket and black T-Shirt valued at R1001.96 (one thousand and one rands and ninety-six cents each (“Combo 6 Limited Edition Merch Prize”); or
viii. 1 of 40 double General Access tickets to the Cassper Nyovest and Nasty C – African Throne 2023 valued at R395.00 (three hundred and ninety five rands) each. This prize solely consists of the tickets to attend the event. All expenses, travel, accommodation, meals, other arrangements and costs are not included in the prize and are the sole responsibility of the winner (“African Throne Ticket Prize”); or
d. Tier 4 (2 valid purchases to qualify):
i. 1 of 15 general double tickets to DSTV Delicious Festival 2023 valued at R950.00 (nine hundred and fifty rands) each. This prize solely consists of the tickets to attend the event. All expenses, travel, accommodation, meals, other arrangements and costs are not included in the prize and are the sole responsibility of the winner (“DSTV Delicious Festival General Ticket Prize”); or
e. Tier 5 (1 valid purchase to qualify):
i. 1 of 25 double General Access tickets to the Cotton Festival 2024 valued at R395.00 (three hundred ninety-five rands) each. This prize solely consists of the tickets to attend the event. All expenses, travel, accommodation, meals, other arrangements and costs are not included in the prize and are the sole responsibility of the winner (“Cotton Festival Ticket Prize”); or
ii. 1 of 50 Coke Studio limited edition bucket hat and black T-Shirt valued at R247.94 (two hundred and forty seven rand and ninety-four cents) each (“Combo 1 Limited Edition Merch Prize”); or
iii. 1 of 50 Coke Studio limited edition bucket hat and red T-Shirt valued at R247.94 (two hundred and forty seven rand and ninety-four cents) each (“Combo 2 Limited Edition Merch Prize”); or
iv. 1 of 180 Coke Studio limited edition backpack and button badge valued at R295.07 (two hundred and ninety five rand and seven cents) each (“Combo 3 Limited Edition Merch Prize”); or
v. 1 of 190 Coke Studio limited edition bum bags and buttons valued at R257.62 (two hundred and fifty -seven rand and sixty-two cents) (“Combo 4 Limited Edition Merch Prize”); or
vi. 1 of 350 Mr Price vouchers valued at R300 (three hundred Rand) each (“Mr Price Voucher”); or
vii. 1 of 100 Krispy Kreme vouchers valued at R250 (two hundred and fifty rands) each (“Krispy Kreme Voucher”); or
viii. 1 of 500 Nandos vouchers valued at R300 (three hundred Rand) each (“Nandos Voucher”);
ix. 1 of 500 3-month Spotify vouchers valued at R190,00 (one hundred and ninety Rand) each (“Spotify Voucher”); or
x. 1 of 700 Superbalist vouchers valued at R300,00 (three hundred Rand) each(“Superbalist Voucher”); or
xi. 1 of 500 KFC vouchers valued at R250 (two hundred and fifty Rand) each (“KFC Voucher”); or
xii. 1 of 200 Steers vouchers valued at R250 (two hundred and fifty rands) each (“Steers Voucher”); or
xiii. 1 of 100 Mr D vouchers valued at R250 (two hundred and fifty rands) each (“Mr D Voucher”); or
xiv. 1 of 250 UberEats vouchers valued at R100 (one hundred rand) each (“UberEats Voucher”); or
xv. 1 of 1000 airtime vouchers valued at R50 (fifty rand) each(“R50 Airtime Voucher”); or
xvi. 1 of 500 airtime vouchers valued at R150 (one hundred and fifty rand) each (“R150 Airtime Voucher”); or
xvii. 1 of 1000 2GB data bundles valued at R149 (one hundred and forty-nine rands) each; (“Data Voucher”);
The Promoters shall solely determine the specifications of each Prize and the Promoters’ decision shall be final in this regard. The description of the prizes is paragraphs 6(c)(vi) and (vii) and 6(e)(ii)-(v) as “combo” is an internal description in order to be able to distinguish these prizes.
Participants acknowledge that there is no guarantee that they will win a prize in this Competition. Prize specifications are subject to change pending stock availability from the manufacturer.
7. The Promoters shall not award a Prize to a winner if it is unlawful to supply such Prize to the winner. In such instance, the winner shall immediately forfeit the Prize and be disqualified.
8. Once the winner has received the Prize, the Promoters shall not be liable and shall not take responsibility for any product malfunction or defect or manufacturing faults or defects, or damage or loss of the Prize. Ownership of and risk in and benefit attaching to the Prize will pass on to the winner immediately. The Promoters do not cover insurance for the Prize once handed over to the winners of this Competition.
Entry mechanic/How to enter:
9. To enter this Competition and stand a chance to win a prize as described in these Terms and Conditions, participants must do the following (there are 2 ways to enter):
a. Buy any participating product and pack size (subject to the minimum number of purchases required to stand a chance one of the prizes as described in paragraph 6 above) (see Annexure A for a list of participating products and packs) from any participating local store which has advertised promotional posters of this Competition, collect their scratch card from the cashier to find their unique code, scan the QR Code on pack to be directed to the WhatsApp chat or message the word ‘Coke’ to 087 133 0080 on WhatsApp and provide their first name, surname and opt-in decision to receive direct marketing messages from CCA and submit the unique code found on the scratch card on the WhatsApp chat; or
b. Buy any participating product and pack size (subject to the minimum number of purchases required to stand a chance one of the prizes as described in paragraph 6 above) (see Annexure A for a list of participating products and packs) from a participating retail or grocery store which has advertised promotional posters of this Competition, scan the QR Code on pack to be directed to a WhatsApp chat or message the word ‘Coke’ to 087 133 0080 on WhatsApp and provide their first name, surname and opt-in decision to receive direct marketing messages from CCA and upload a photo of their till slip or proof of purchase (participants must retain a copy of such till slip).
Purchase of the participating products from the participating stores must be made during the Competition Period. Any purchases made before or after the Competition Period do not qualify.
Selection:
10. Winners of HeyNeighbour Festival General Weekend Ticket Prize: A random draw will be conducted on 27 November 2023 by an independent auditor, to select a total of 60 potential winners of the HeyNeighbour Festival General Weekend Ticket Prize as described in these Terms and Conditions. The potential winners of the HeyNeighbour Festival General Weekend Ticket Prize will be notified within 2 weeks of the relevant prize draw taking place via a phone call using the number that the potential winner used to enter the Competition, and will be subject to a verification process where they will be required to provide a valid identity document, daytime delivery address details and complete a verification document subject to the timelines that will be provided by the Promoters. If verification is successful, the potential winners will be declared official winners and a confirmation email will be sent. In addition, the winners will be required to sign and return to the Promoters, within five (5) days of the date notice is sent, an acknowledgement of the prize and indemnity form ("Declaration") to claim their Prize and to fulfil any such other requirements as determined by the Promoters. If a potential winner fails the verification process for whatsoever reason or a winner fails to send the complete Declaration within the timeline communicated, such person will be disqualified and shall not receive a Prize, and a replacement draw and winner will take place. The selection of the winner for the Prize is final and binding in all matters related to the Competition. Delivery of the prize will be made via WhatsApp before the 8th of December 2023. For any physical delivery if applicable, should a verified winner not be available to sign for the delivery at the provided address only 1 further delivery attempt will be made. Should the winner fail the second delivery attempt, the prize will be immediately forfeited by the winner and subject to a re-draw.
11. Winners of HeyNeighbour Festival VIP Weekend Ticket Prize: A random draw will be conducted on 27 November 2023 by an independent auditor to select a total 50 potential winners of the HeyNeighbour Festival VIP Weekend Ticket Prize as described in these Terms and Conditions. The potential winners of the HeyNeighbour Festival VIP Weekend Ticket Prize will be notified within 2 weeks of the relevant prize draw taking place via a phone call using the number that the potential winner used to enter the Competition, and will be subject to a verification process where they will be required to provide a valid identity document, daytime delivery address details and complete a verification document subject to the timelines that will be provided by the Promoters. If verification is successful, the potential winners will be declared official winners and a confirmation email will be sent. In addition, the winners will be required to sign and return to the Promoters, within five (5) days of the date notice is sent, an acknowledgement of the prize and indemnity form ("Declaration") to claim their Prize and to fulfil any such other requirements as determined by the Promoters. If a potential winner fails the verification process for whatsoever reason or a winner fails to send the complete Declaration within the timeline communicated, such person will be disqualified and shall not receive a Prize, and a replacement draw and winner will take place. Winners of HeyNeighbour Festival VIP Single Day Ticket Prize: A random draw will be conducted on 27 November 2023 by an independent auditor to select a total of 50 potential winners of the HeyNeighbour Festival VIP Single Day Ticket Prize as described in these Terms and Conditions. The potential winners of the HeyNeighbour Festival VIP Single Day Ticket Prize will be notified within 2 weeks of the relevant prize draw taking place via a phone call using the number that the potential winner used to enter the Competition, and will be subject to a verification process where they will be required to provide a valid identity document, daytime delivery address details and complete a verification document subject to the timelines that will be provided by the Promoters. If verification is successful, the potential winners will be declared official winners and a confirmation email will be sent. In addition, the winners will be required to sign and return to the Promoters, within five (5) days of the date notice is sent, an acknowledgement of the prize and indemnity form ("Declaration") to claim their Prize and to fulfil any such other requirements as determined by the Promoters. If a potential winner fails the verification process for whatsoever reason or a winner fails to send the complete Declaration within the timeline communicated, such person will be disqualified and shall not receive a Prize, and a replacement draw and winner will take place. Winners of Speaker Prize: A random draw will be conducted monthly in accordance with the dates set out below in this paragraph by an independent auditor to select potential winners of the Speaker Prize as described in these Terms and Conditions. The potential winners of the Speaker Prize will be notified within 2 weeks of the relevant prize draw taking place via a phone call using the number that the potential winner used to enter the Competition, and will be subject to a verification process where they will be required to provide a valid identity document, daytime delivery address details and complete a verification document subject to the timelines that will be provided by the Promoters. If verification is successful, the potential winners will be declared official winners and a confirmation email will be sent. In addition, the winners will be required to sign and return to the Promoters, within five (5) days of the date notice is sent, an acknowledgement of the prize and indemnity form ("Declaration") to claim their Prize and to fulfil any such other requirements as determined by the Promoters. Second draw will take place on 16 October 2023 to select the other 23 potential winners
Third draw will take place on 1 November 2023 to select the other 22 potential winners
Fourth draw will take place on 10 January 2024 to select the other 23 potential winners
14. Winners of AirPods Gen3 Wireless Prize: A random draw will be conducted monthly in accordance with the dates set out below in this paragraph by an independent auditor to select potential winners of the AirPods Gen3 Wireless Prize as described in these Terms and Conditions. The potential winners of the AirPods Gen3 Wireless Prize will be notified within 2 weeks of the relevant prize draw taking place via a phone call using the number that the potential winner used to enter the Competition, and will be subject to a verification process where they will be required to provide a valid identity document, daytime delivery address details and complete a verification document subject to the timelines that will be provided by the Promoters. If verification is successful, the potential winners will be declared official winners and a confirmation email will be sent. In addition, the winners will be required to sign and return to the Promoters, within five (5) days of the date notice is sent, an acknowledgement of the prize and indemnity form ("Declaration") to claim their Prize and to fulfil any such other requirements as determined by the Promoters. If a potential winner fails the verification process for whatsoever reason or a winner fails to send the complete Declaration within the timeline communicated, such person will be disqualified and shall not receive a Prize, and a replacement draw and winner will take place. Winners of Beats Studio Buds Prize: A random draw will be conducted monthly in accordance with the dates set out below in this paragraph by an independent auditor to select potential winners of the Beats Studio Buds Prize as described in these Terms and Conditions. The potential winners of the Beats Studio Buds Prize will be notified within 2 weeks of the relevant prize draw taking place via a phone call using the number that the potential winner used to enter the Competition, and will be subject to a verification process where they will be required to provide a valid identity document, daytime delivery address details and complete a verification document subject to the timelines that will be provided by the Promoters. If verification is successful, the potential winners will be declared official winners and a confirmation email will be sent. In addition, the winners will be required to sign and return to the Promoters, within five (5) days of the date notice is sent, an acknowledgement of the prize and indemnity form ("Declaration") to claim their Prize and to fulfil any such other requirements as determined by the Promoters. 16. Winners of DSTV Delicious Festival VIP Tickets Prize: A random draw will be conducted on 31 August 2023 by an independent auditor to select potential winners of the DSTV Delicious Festival VIP Ticket Prize as described in these Terms and Conditions. This prize solely consists of the tickets to attend the event. All expenses, travel, accommodation, meals, other arrangements and costs are not included in the prize and are the sole responsibility of the winner. The Promoters are not responsible for the postponement, or cancellation of the event for whatever reason and the Promoters will not be liable for any loss, claim, costs or expenses due to or incurred by the winner due to such postponement or cancellation of the event. The Promoters have the right, in their sole discretion, to disqualify and remove a winner or the winner’s guest from any activity at any time if the winner’s or the winner’s guest’s behaviour at any point is uncooperative, disruptive, or may or does cause damage to person, property, or the reputation of the Promoters. All expenses, elements and other costs not expressly stated in the prize package description above are the sole responsibility of the winner. Winner shall be responsible for complying with any and all COVID-19 requirements or other requirements set forth by the Promoters, event organisers and government authorities. Failure to comply with any required requirements will result in forfeiture of select elements of the prize or the entire prize.
The potential winners of the DSTV Delicious Festival VIP Tickets Prize will be notified within 2 weeks of the relevant prize draw taking place via a phone call using the number that the potential winner used to enter the Competition, and will be subject to a verification process where they will be required to provide a valid identity document, daytime delivery address details and complete a verification document subject to the timelines that will be provided by the Promoters. If verification is successful, the potential winners will be declared official winners and a confirmation email will be sent. In addition, the winners will be required to sign and return to the Promoters, within five (5) days of the date notice is sent, an acknowledgement of the prize and indemnity form ("Declaration") to claim their Prize and to fulfil any such other requirements as determined by the Promoters. If a potential winner fails the verification process for whatsoever reason or a winner fails to send the complete Declaration within the timeline communicated, such person will be disqualified and shall not receive a Prize, and a replacement draw and winner will take place. Winners of JBL Tune 770 Prize: A random draw will be conducted monthly in accordance with the dates set out below in this paragraph by an independent auditor to select potential winners of the JBL Tune 770 Prize as described in these Terms and Conditions. The potential winners of the JBL Tune 770 Prize will be notified within 2 weeks of the relevant prize draw taking place via a phone call using the number that the potential winner used to enter the Competition, and will be subject to a verification process where they will be required to provide a valid identity document, daytime delivery address details and complete a verification document subject to the timelines that will be provided by the Promoters. If verification is successful, the potential winners will be declared official winners and a confirmation email will be sent. In addition, the winners will be required to sign and return to the Promoters, within five (5) days of the date notice is sent, an acknowledgement of the prize and indemnity form ("Declaration") to claim their Prize and to fulfil any such other requirements as determined by the Promoters. If a potential winner fails the verification process for whatsoever reason or a winner fails to send the complete Declaration within the timeline communicated, such person will be disqualified and shall not receive a Prize, and a replacement draw and winner will take place. The selection of the winner for the Prize is final and binding in all matters related to the Competition. Delivery of the prize will be made within 8 weeks of the winner being successfully verified. Should a verified winner not be available to sign for the delivery at the provided address only 1 further delivery attempt will be made. Should the winner fail the second delivery attempt, the prize will be immediately forfeited by the winner and subject to a re-draw.

The prize will be topped up to their device automatically within 72 hours of the draw being conducted. Each airtime voucher is valid for 30 days from date of receipt. The Airtime Voucher Prize are for different mobile network providers in South Africa and the choice of the network providers will be at the sole discretion of the Promoters.
41. Winners of Data Voucher: Winners of a Data Voucher Prize will be selected daily during the Competition Period using an automated random computerised competition service which will be conducted by VPAS, and will find out instantly if they have won on the number that they used to enter this Competition. The prize will be topped up to their device automatically within 72 hours of the draw being conducted. The Data Voucher is valid for 30 days from date of receipt. The Date Voucher are for different mobile network providers in South Africa and the choice of the network providers will be at the sole discretion of the Promoters.
42. If the Promoters (whether directly or through their agencies) are unable to contact or reach a potential winner on his or her mobile number used to enter into this Competition after drawing his or her entry for whatever reason within 48 hours from the date of first notification as set out in these Terms and Conditions or if an official winner cannot be contacted within 48 hours from the date of being declared an official winner or a winner fails to redeem a voucher prize within 1 (one) month of being notified, or if a winner forfeits a Prize for any reason, or if a person is not eligible to enter into this Competition, or if a potential winner fails the verification process after drawing his/her entry for whatsoever reason or if a potential winner or official winner fails to provide any required information within the timelines stipulated or if a winner refuses to accept the Prize or refuses or fails to sign and send to the Promoters the acknowledgement of receipt of the Prize, then such person will immediately forfeit their chance to win the Prize or the Prize and will be immediately disqualified from this Competition and an alternate potential winner from all remaining eligible entries (up to 3 (three) alternate potential winners will be permitted at the sole and absolute discretion of the Promoters) will be drawn. If the alternate potential winner/s are disqualified for whatever reason, the applicable Prize will not be awarded and the Promoters will decide what to do with the unawarded Prize at their sole and absolute discretion.
43. The Promoters’ decision in this Competition will be final and no correspondence will be entered into.
44. Participants may enter the Competition subject to the following:
a. No automated entries will be allowed and all entries must be made by a natural person manually as per the entry mechanic described above.
b. If any entry was made in a manner which at the Promoters’ discretion provides the participant with an unfair advantage over other entrants, such a participant will be disqualified from this Competition.
c. Participants are limited to 5 entries per day and 100 over the duration of the Competition Period provided they complete the entry mechanics set out above each time.
d. The Promoters shall not be responsible for any lost, damaged, delayed, incorrect or incomplete entries for any reason whatsoever including but not limited to any network, computer or cell phone hardware or software failure of any kind. Proof of sending will not be accepted as proof of receipt.
e. The Promoters shall not be responsible for the failure of any technical element relating to this Competition that may result in an entry not being successfully submitted.
f. The Promoters reserve the right to disqualify any claim if fraud or cheating is suspected, including without limitation, through the manipulation of code or otherwise frequently falsifying data.
45. The Prize winners are obligated to behave responsibly and comply with these Terms and Conditions and all reasonable requests of the Promoters.
46. The Prizes are not transferable or redeemable for cash or any other item.
47. All participants and the winners, as the case may be, indemnify the Promoters, the Promoters’ advertising agencies, advisers, nominated agents, partners, suppliers and bottlers of beverages identified by the trademarks owned by or licensed to The Coca‑Cola Company, its affiliates and/or associated companies, against any claims of any nature whatsoever arising out of and/or from their participation in any way howsoever in this Competition (including, as a result of any act or omission, whether as a result of negligence, misrepresentation, misconduct or otherwise on the part of the Promoters and/or receipt and/or use of the Prize).
48. Publicity: The Promoters may require the winners to be identified, photographed and published in printed media, or to appear on radio and television or social media platforms or other platforms, when accepting their Prize/s or after having received their Prize. The winners will be allowed to decline the publication of their images and to participate in the Promoters’ marketing material in so far as it relates to the Competition.
49. By entering into this Competition, each participant hereby consents and irrevocably grants to the Promoters, a worldwide, royalty free (free from any other fee or charge), perpetual and non-exclusive license, to reproduce, modify, adapt, use and publish any content posted and/or submitted by the participant on any social media platform in relation to the Competition or the Prize, for any purposes including the promotion of the products and services of the Promoters or affiliates of the Promoters without notice or any compensation to the participants. The participants further hereby irrevocably grants to Promoters and the Promoters’ affiliates, a royalty-free, irrevocable, perpetual, and absolute right and permission to use, produce, reproduce, modify, publish, and display (including to incorporate it into other works, in any form, media or technology now known or later developed) a participant’s name, image, moving image, videos, voice and/or photograph in relation to the Competition or the Prize, including the participant’s participation in any aspect of the Competition or the Prize, in any and all advertising, posts and materials in any manner or media whatsoever, on a worldwide basis, for advertising and promotional purposes in conjunction with this Competition or any other competitions run by the Promoters without notice or any compensation to the participants.
50. Data Privacy: All personal information of the participants will be processed in accordance with the Protection of Personal Information Act 4 of 2013 (“POPIA”) and shall be subject to CCA’s Privacy Policy found at https://www.coca-cola.com/za/en/legal/privacy-policy The participants’ personal information collected in this Competition will be collected via the Whatsapp bot as mentioned in the entry mechanic above and will be accessed by all the Promoters for the purposes of this Competition. The personal information will be retained for the duration of this Competition and for additional 3 (three) years from the end date of this Competition to comply with applicable laws. By entering into this Competition, participants acknowledge and understand that: (a) it is mandatory for all participants to provide their personal information in order to participate in this Competition failing which the participants will not be able to enter into the Competition; (b) the participants’ personal information shall be used for the purposes of processing their entry into this Competition (and verification purposes and prize delivery purposes depending on the prize as described above) and additional purposes as detailed in CCA’s Privacy Policy found here: https://www.coca-cola.com/za/en/legal/privacy-policy; (c) The Coca‑Cola Company and its affiliates (including CCA, subsidiaries, its bottlers and joint ventures) may contact the participants via email, SMS, social media platforms and through other platforms to deliver marketing communications regarding their products and promotional activities, subject to the participant’s prior consent and in accordance with the provisions of POPIA; (d) they hereby consent to the Promoters transferring the participants’ personal information outside the Republic of South Africa. Any data transfers to countries that do not offer an adequate level of protection are subject to appropriate safeguards in accordance with the POPIA, to guarantee that participants’ personal information is adequately protected, including standards.
51. The Promoters may require the winners to complete and submit an information disclosure agreement and indemnification to enable the Promoters to ensure compliance with these Terms and Conditions and the Consumer Protection Act 68 of 2008. Should any winner refuse or be unable to comply with this rule for any reason, such a winner will be deemed to
52. In the event of unforeseen circumstances or causes beyond the Promoters’ reasonable control, the Promoters reserve the right to cancel this Competition, to change the number or nature of the prize at any time, or to change the Terms and Conditions at their discretion.
