Fanta Halloween Haunted Factory Event Photo and Liability Release 

Except where prohibited by law, I hereby irrevocably grant The Coca‑Cola Company (“Sponsor”) and its partners, licensees, parents, subsidiaries, affiliates, assigns, related companies, advertising and promotional agencies, successors, and all of their respective officers, directors, employees, representatives and agents (collectively the “Sponsor Entities”) the universal and perpetual right and license to make, use, exploit, print, publish, broadcast, reproduce, display, distribute and modify any Photographic Content (as defined below) as well as other works derivative of my name, actual or simulated likeness, photograph, video, image, voice, portrait, picture, personal characteristics, biographical information and other personal identification in any and all languages, throughout the universe, and in any manner, formats, and media now known or hereafter developed, including, without limitation, on TV, cable or satellite broadcasts and on social networking websites and other Internet uses, in connection with the Fanta Halloween Haunted Factory Event (the “Event”) and/or any Event-related activity and any and all advertising, promotion, marketing, and/or publicity thereof, including all ancillary and subsidiary rights therein, without additional consideration or compensation. I further agree that this license shall be freely transferable without my prior approval or consultation.

The Photographic Content includes all content generated and/or exhibited in connection with the Event and encompasses all activities in and around the Event. Sponsor Entities shall have complete ownership of the Photographic Content, including full domestic and foreign copyright, and shall have the exclusive right and license to make such use of the Photographic Content as it wishes, including (but not limited to) the right of performance, display and reproduction and the right to create, perform, display and distribute derivative works of the Photographic Content. The right to use is understood to include the right to make alterations or additions to the Photographic Content and to register the copyright(s) for the Photographic. I also understand the Sponsor Entities has no obligations to use the Photographic Content. I assign all rights and titles, including all copyright rights in the Photographic Content and its derivative works to the Sponsor Entities.

I hereby release the Sponsor Entities from any and all claims for damages for defamation, infringement of the right of publicity, invasion of privacy, portrayal in a false light, or any other claim based on or arising from the use of the Images.

I, for myself and on behalf of my heirs, estate, insurers, executors, successors and assigns, hereby agree to release, indemnify, and hold harmless The Coca‑Cola Company, and their respective subsidiaries, affiliates, officers, directors, shareholders, employees, contractors, agents and representatives, and the successors, assigns, and insurers of such entities, and any other sponsors, advertisers, agencies, producers, owners or lessors of premises used in connection with the Event, (collectively, the “Released Parties”), from and against any and all claims or causes of action that I or my heirs, estate, insurers, executors, successors and assigns may have for damages for personal or bodily injury, disability, or death, for loss or damage to person or property, and/or for violation of privacy/publicity rights, and attorneys’ fees and expenses for litigation and settlement in connection therewith, that may arise from or in connection with my participation in this Event, whether arising from the negligence of any or all of the Released Parties or otherwise, to the fullest extent permitted by law.

I am of full and legal age and have every right to contract in my own name (if not, parent or guardian must sign as indicated).

I HAVE READ THE RELEASE CAREFULLY, FULLY UNDERSTAND ITS CONTENTS and VOLUNTARILY AGREE TO ITS TERMS.
